K2 for my Daughter

Hello everyone! This is my first post and I have quite a couple of concerns. I have a daughter who turned 19 this October. I married a US citizen and is still waiting for my adjustment of status since we just married this month. I'd very much like my daughter to be with me in the US and I know that I have a year's time to do the paperworks so she can follow to join me. I have some concerns:

1) I know she needs to comply with the requirements (same as I did as a K1 Visa holder) - Pay visa fee, Get medical at St. Luke's, and US Embassy interview plus of course the usual documents like birth certs, nbi clearance, etc. Where do I start? Shall I email the US Embassy in Manila or what documents do I need to file here in the US?

2) If she is granted a K2 Visa to follow me, does she also need to go thru the same Adjustment of Status that I did like paying a total of $1,070 for the I-485 and biometrics?

3) If she is to go thru the Adjustment Status, how long is the usual processing time?

4) Since I married a US Citizen, can she apply for a US citizenship immediately or does it have to take years again?

5) On filing for Advance parole, can I state that I wanted to visit her in the Philippines to assist her in the application process?

Did the petitioner list her on the K1? How long has it been since the K1 was issued? K2 kids have one year to follow. I think the age is frozen during this step for kids near the cut off but you have to act within the time frame.

Since you haven't filled in your timeline, we must assume? that your K-1 visa was issued less than one year ago? The K-2 visa for a child To Follow must be issued within one year of the issuance of the K-1. If it will be more than one year, then you can't use the K-2 anymore. Email the Embassy is correct.

2) If she is granted a K2 Visa to follow me, does she also need to go thru the same Adjustment of Status that I did like paying a total of $1,070 for the I-485 and biometrics?

Yes, everything except if you send them a copy of your AOS filing, I believe the cost is less, just as if you filed the K-2 AOS along with the K-1 AOS.

3) If she is to go thru the Adjustment Status, how long is the usual processing time?

The usual time, about 5 months.

4) Since I married a US Citizen, can she apply for a US citizenship immediately or does it have to take years again?

Don't know that answer but not immdediately for sure.

5) On filing for Advance parole, can I state that I wanted to visit her in the Philippines to assist her in the application process?

Sure.

I was granted the K1 Visa on July 2012. So it follows that I need to file for my daughter's K2 before July 2013? I hope you can also reply on my Question NO. 4. Thanks.

No, her K-2 visa must be ISSUED prior to your one year time-frame....so you'd file for it earlier to ensure it gets issued prior to the one year.

just follow the same instructions on what u did in ur k1 interview... no docs. to be file here in the US to get her visa.

yes she needs to file her K2 AOS here in the USA, pay $985 for AOS, EAD and AP...no fee for bio.

same as our AOS timeline...

she needs to wait for 5 yrs. unlike us that we can apply US cit. after 3 yrs.

5) On filing for Advance parole, can I state that I wanted to visit her in the Philippines to assist her in the application process?

once u get ur AP then yes u can go back home to PI to assist her in her K2 visa process..

all u have to do is go to slec do the medical bring the same instruction letter that the US Embassy sent to u delivered by air21... then sched. for k2 interview...

N-400:

You just listed the steps....no need for the latter....unless there is something unique, your child's visa should be granted. I suggest you move your questions to the appropriate regional forum since everything can be very Embassy specific.
