Confused before we even start.

Timeline

Hello, new to VJ here. I have browsed around but I can't quite find someone elses situation that fits. I am an American currently stationed in Korea. My Fiance is from the Philippines. She is divorced but never got her annulment from the Philippines. Now we are looking for the fastest way to rush as much of the paperwork as we can before her Korean visa expires in about 3 months. I have less than that here in Korea before I leave, so there's not enough time to go through the steps that the military requires for marriage in Korea. With waiting on the annulment, we would certainly not have time to go through the military anyway. I hear the annulment takes up to a year to process.

Originally, we had planed to go the military route but the Philippine Embassy told her she needs a Certificate of Singleness, which she said she can't get without the annulment. And apparently doing the Fiance Visa itself would require the annulment also.

I was considering having her go for just a tourist visa while we wait for her annulment to go through, then put in for the Fiance visa but apparently she can't visit the US on her Korean F-2.

We have also heard that she can do a Recognition for Foreign Divorce because her ex is Korean, but I haven't found much info on this and until I do, I'm not sure I trust it.

Just looking for someone that maybe has some experiance with the Recognition for Divorce or has been though this situation that could provide a little guidance on the fastest route to a visa.

where was the divorce filed? If the korean spouse initiated the divorce it shouldnt be much of an issue unless they were married in the PI. (but I havent done any research on annulment) If they were, then annulment is the only way and it is a long and expensive road. There will probably be a few appointments that she needs to do in the PI before the annulment is finalized.

So did they report the marriage to the PI or were they married in the PI? If they did neither, than she should be able to get her singleness with no issues.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.
