Hi friends! I would like to ask your opinion in behalf of my sister's friend situation. She and her fiance want to file for K1 petition but very anxious about their age gap. This lady is only 19 years old while her fiance is 44. She never went to college but graduated in highschool. Has any of you here encountered such situation? Do you guys think that their age gap would a red flag of their case?

They really love each other though. The man visited her twice last year.

Hello Lai. There is nothing to stop them from filing a petition. The age gap would be looked at but many have been approved and I never heard of age gaps being a reason for denial. Her education background does not matter. If they can meet the filing requirements there good to go. You look alot younger than your Fiance'. LOL. I'm 50 and Mav is 34. But, please tell your friend: She will need Parental Consent from Tatay or Nanay or the closest relative due to her age. (That won't be required until a later date) 19 and 44 is a huge gap. But, I seen it happen here. I just hope they realize what their doing and the challenges ahead.

Hello Lai. There is nothing to stop them from filing a petition. The age gap would be looked at but many have been approved and I never heard of age gaps being a reason for denial. As others have said the age gap will be looked at, but it is part of the culture in the Philippines for a younger lady to marry and older gentleman. You need to consider what it will mean for you, and yes you will need to get permission to married when the lady is that young.

Age gap! :rofl: Now there is a topic that gets around pretty regular. There are MANY, and I do mean many, that have married and done the visa process with larger age gaps then that. :whistle: The embassy isn't going to care, what they will care about is if the relationship is genuine and real ...

As others have mentioned you will need a letter of consent, CFO will want to see this for sure, not sure about the embassy, but for one piece of paper it won't hurt to bring a copy there also.

* From the Family Code of the Philippines: it's 21-25 years old for advice and 18-21 years old for consent. (Some are posted on VJ that they were not asked for this, yet others have been asked, so be prepared)

Art. 14. In case either or both of the contracting parties, not having been emancipated by a previous marriage, are between the ages of eighteen and twenty-one, they shall, in addition to the requirements of the preceding articles, exhibit to the local civil registrar, the consent to their marriage of their father, mother, surviving parent or guardian, or persons having legal charge of them, in the order mentioned. Such consent shall be manifested in writing by the interested party, who personally appears before the proper local civil registrar, or in the form of an affidavit made in the presence of two witnesses and attested before any official authorized by law to administer oaths. The personal manifestation shall be recorded in both applications for marriage license, and the affidavit, if one is executed instead, shall be attached to said applications. (61a)

Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor.A sworn statement by the contracting parties to the effect that such advice has been sought,together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement.

Yes, there is some members here that they thought age gap would be a problem, but it's not.. There is alot of members here have a age gap differences more than 20"s age gap but still got approved and there is no problem, as long as they have enough proof of genuine relationship, so it will be alright good.gifkicking.gifkicking.gifkicking.gif

A lot here have +20 age gap and got approve without problem as long as there's substantial evidence of bonafide relationship.

Age gap isn't looked upon any differently. It's a process and you have to meet the requirements of the process.

We have a good age gap between us, was never an issue. Even with friends and family they don't care,or even see it because they have witnessed the true love between us. I will tell you that it doesn't come without some struggles. And thats exactly why we lived with each other in the Phils so I knew it would work and that there would be no

surprises.

Yes most definitely a 44 year old man filing a fiancee visa for a 19 year woman would be a big red flag. The red flag does not mean a visa denial, just that the consular officer probably will scrutinize the legitimacy of the relationship a lot more. They need to start to prepare some strong documentary evidence that the relationship is legitimate. Affidavits of friends and family members with actual knowledge of their relationship. Proof of a relationship that has developed over time and included regular visits and correspondence over an extended period of time. Pictures of them together with different dates, times and places. It is not the age difference that is the problem, it is her age (19) that will red flag it.

They may want to consider getting married in the Philippines, then file for a visa for her under CR-1.

If 19 years of age would be a red flag for a K-1, it would be a red flag for an IR-1 as well, marriage wouldn't make things different in the embassy's eyes ... they would still be looking for a real relationship and evidence of same.

Thank you, everyone for your responses. I told her that it shouldn't be that big deal but the her man is still worry about it so they will hire a lawyer to hold their case. Also, I think their engagement on December will help to improve the evidence of their genuine relationship.

We speak from experience, not assumptions and opinions. Don't worry about the age and definitely go the K-1 visa route if that is best for you. I'm 40 with a young wife and never once had any issues. Good luck, oh I mean for your sister's friend.

An attorney can not do anything for you that you can not do yourself. In fact everything that is needed the attorney will request from you. Forms are forms, complete them..
