Hi everyone,

My boyfriend came to the United States from Germany on the ESTA program, however he violated it by 1 day. When he tried to return to the country they sent him back because of the violation and said he could only return with a Visa but that might not even work. So I was wondering if once we get married (in Germany), if he'll be allowed to come to America with me for a few weeks to visit or if he's still not allowed until he gets his residence permit?

He would need a B2 Visa to visit you. If this is a recent issue I would think it would be a long shot, but he would need to apply to find out.

To visit the US then somebody not eligible for the VWP needs a visa. The Visitor Visa is the B2.

Being married by itself, does not give any benefit or special status. Marrying him will not give him permission to visit. He can apply for a B2 for visiting, on his own.

ESPECIALLY if you are married. He is now/ will be married to a US citizen and so has even more reason to stay illegally than last time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It is highly unlikely that your (then) husband with overstay on his record would be able to obtain a B2.
