Advice Needed K1 Visa

Isn't there a relative visa that can be filed by you for him - the cousin? I am not sure what relationship you must be in to initiate that. However, I completely agree that your cousin has to go back to his Country 'on time.' If he really does want to be here, he must not red flag himself by staying past the expiration date of the K1 visa! He will not be trusted again if/when he applies for any other visa in the future. Again, the K1 Visa is a fiance visa and I have read a lot about it while we are going thru the process and before we started. You cannot convert the K1 to a different Visa. You do have to go back to your Country when that visa expires.

Also agreed that I do not know the whole story...this is odd. My Fiance and I are tortured every single day we are apart! I cannot image anything but to be together again. Why would someone go through all of this to simply turn their back? Why even complete this long process if there are any doubts that you've found the love of your life?

If they are not going to marry...I strongly suggest that he go back before the Visa expires and research other visa types to live here.

He should go back home and show that he can be trusted with a Visa to the USA and that he will follow directions and do what he is supposed to do. This will give him credibility when he goes to apply for another Visa. Have him go back home and then if he wants to come back he should file for a different type of Visa.

Don't let him stay illegally. My husband, used to be fiance, is here with me and we did get married. However, our marriage didn't give him the right to work and drive and all those things that he needs to do until we apply for our Adjustment of Status. Until he gets his green card he is having to stay at home bored out of his mind. So trust me. Tell him to go home and do things the right way.

Good Luck!
