even though my wife and I have lived in our new house since May, we have yet to notify USCIS for our change of address since the address she is registered with them is my parent's address. but since we're about to file for her adjustment of status within the next month, we should change the address. Are we going to be in any kind of trouble for not filing for the change of address when we moved into our house since the instructions state that the change of address should be filed within 10 days of moving? and is it better to change the address online through uscis.gov or just mailing the form AR-11?

There are a lot of illegal immigrants here to worry about, don't worry about that. When you file the adjustment of status just put the new address. If you are sponsoring your wife, or whoever sponsored here (who signed the affidavit of support), should file the AR-11. US citizens are required to do that when they are sponsoring somebody.

Sounds like an easy fix, now that you have a new permanent residence established. I try to keep on top of this stuff so we don't have any issues that are not needed.

do the ar-11 for your wife online and once it is confirmed, print it out for your records. the sponsor has to mail out the 1-865 form and once they received your 1-865 form, they will send you a receipt stating they had received your 865 change of address form.

AFTER you file for AOS and have an I-864 on-file, the USC sponsor(s) must notify the USCIS when they (the sponsor) move within 10 days using the I-865 which is mailed in. The Permenant resident alien notifies the USCIS of moving within 10 days using the AR-11 which can be filed on-line until they obtain citizenship. The USC must notify the USCIS until the terms of the I-864 have been met.

In you case, I would file the AR-11 and then put your new address on the AOS application. You might want to start filling in the I-751 for ROC with the dates your spouse has lived at for the last five years and the N-400 when she travels outside the US. Easier to do it as you go then try to remember dates when the time to fill the form out comes along. It will also help remind you to keep documentation too.

Good luck,

Dave

I'm confused on what to do now. should I just continue using our old address(my parent's address) my wife and are registered with? or go ahead and file for our current address despite that we've been here at our new house much longer than 10 days. all of our bonafides (bills and bank statements) have both of our names with our new address since may or june. are we going to be in trouble?

I meant to say we're about to file for the removal of conditions. not the adjustment of status.

If you are now living at the new address and have not filed the AR-11 on-line and mailed in the I-865 do so before filing the ROC. Then put the new address on the ROC applicaton. Given the number of businesses and government agencies one has dealings with, it is hard to remember who you have changed your address with when you move. As long as you do it at some time is better than not doing it at all.

Good luck in getting to this stage of the immigration process.

before I do all this, I just want to get everything straight. (forgive my stupidity) so, I do the AR-11 online for my wife and I fill out the I-865 for me? I just don't want any screw-ups. thank you all for your help.

Yes. Complete the change of address online for your wife and then mail out your I-865.

I'm having a problem with the online AR-11 for my wife. two things. it's asking if the current address is temporary, how long do I(my wife) expect to stay there. well, the current address is our permanent address, but it's not letting me leave that part blank. and the second part is asking if my wife isn't a permanent resident, when will her stay in the US expire? It won't let me leave that part blank either. what should i put there?
