Robee,

You can always try submitting an I-130 to the consulate in Ukraine. They may accept it for processing or they may decline to process it when they see that you already have a petition pending at the CSC.

I was hoping that they could just look up the case and take on the ball

Not at all.

You would need to re-file an I-130, directly with the Consular Section.

I am on the same boat...I had no idea about DCF, and hubby was here early last year!!! So many MONTHS wasted :(

Anyways, I e-mailed the Consulate here in Sydney and they said I can re-file it. I e-mailed the Consulate today, about what to do with the submitted I-130 -- if i do need to mail USCIS and cancel, will keep you posted. I will most likely see how the current I-130 goes and take it from there.

I will also get hubby to e-mail the Sydney Consulate (i.e beg and grovel), if once the I-130 is approved, if it can be transferred from the NVC to them. If not, we at least know we can re-file the I-130 DCF in Jan...

So just e-mail or call your respective consulate and goodluck!

Ohhh Caroline I hope you are right!! He won't be here until early Jan...so I hope the process doesnt change as we've had badluck with it :( ...anyways we are aiming for me to fly to the States 3rd week of March. I don't mind even pushing it a month bank...I just want the visa in my hand!!

To get ready...basically, I should have my police certificate, medical vacinnations up to date, the DS230 Part 1 & 2 form studied and maybe completed and hubbys I-864 ready prior to us filing for the I-130 petition right? I will also book a medical with the doc in Sydney once I know the exact date hubbys flying. That's pretty much it right? From my understanding, we file the I-130 on a Thursday walk-in then if approved, they give you a Packet 3 containing the DS230 Part 1&2 and DS2001 arrives in Packet 4 I think? THEN after thats been submitted an interview is scheduled? And if successful, you get your visa the next business day.

Okay so I e-mailed the consulate and they said to file the petition with them first and then tell USCIS to cancel it.

So yeah your best bet is to contact your consulate directly!

Hi again Elle

You've pretty much got the timing right, but just a couple of notes. They'll give you/your hubby packet 3 when he files the I-130. It will contain the medical forms, DS230 parts 1 & 2, DS2001, and I-864. Packet 4 is just your appointment letter, which you'll get after filing the DS230 parts 1 & 2 and the DS2001 telling them you're ready for an interview. The I-864 is filed when you go for your interview, which is also when you give them your police check and medical info. My signature is a little different, but that's because we got packet 3 before they changed the system.

Don't worry, I'm sure it will all work out fine!

Chris

30 June 2006 - received packet 3 from Sydney Consulate to do DCF

July 2006 - discover Sydney are changing their DCF process

8 September 2006 - have fingerprints taken, post police check form to AFP

12 September 2006 - medical

21 September 2006 - receive police check from AFP

23 September 2006 - wedding day!

12 October 2006 - hubby files I-130 in Sydney during Thursday walk-in (and I-864). I file DS-230 parts 1 and 2, and DS-2001.

31 October 2006 - interview date... and I'm approved!

1 November 2006 - pick-up visa from Sydney Consulate

14 November 2006 - arrive in the US!

22 November 2006 - greencard arrives in mail

24 November 2006 - social security card and welcome letter arrive
