i originally petitioned for an I 130 for my husband of april of 2011. our interview date was on 1/23/12, we were denied and petition sent back for 212(a)©(6) (1) misrepresentation/fraud basically they think our marriage is fake. we didn't have much proof and the proof that we did have such as all the trips ive made to see him they refused to look at. anyways post decision activity is supposed to be about 4 to 6 months and ive already made 6 months a couple weeks ago, since my petition was so unorganized and unprepared i was thinking of starting over with the help of an attorney. has anyone done this before.

I am not sure what stage you are in. My husband and I got married October 16, 2010. Our visa was denied at first interview on January 12, 2011. We received an Notice of Intent to Revoke on September 7, 2012. They received our response to the NOIR on September 17th. Last Wednesday or Thursday I was contacted by homeland security for an interview for me. I am still waiting to hear if we are approved for a second interview. I believe starting over at this point for any of us would be going back to square one. I do not think you start over until you get a NOIR and response to your new evidence.

I'm confused .. What post decision activity are you talking about? When you're denied, it's done unless you file a motion to re-open.

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot

our case was sent back, to uscis we were denied at the interview and we are waiting from a response from uscis they said 4 to 6 months we just past the 6 month mark and i feel like starting over would be a good idea

Hey,

From what I've read/heard it's not worth starting over, because they can go ahead and deined you again. as the previous post said, I think you should wait to rec'd a NOIR, your already hit your 6month, give it about 1 wk call them and follow up, maybe they should have an answer.... Wait before seeking help of an attornery you came thus far. Just hang in there...
