I brought my wife on a K1 visa and applied for her green card through the I-485 form and sent it out while I was employed. I then did the biometrics and was recently layoff. It is my first time being unemployed. What can I expect? I am looking for a job everywhere but I don't know my chances since we are so close to Christmas. I had the biometrics done on October 3rd, 2012 and they were accepted on the 6th. I believe after a month we should get a letter letting us know about the interview. I am very concerned. I love my wife and this has gotten my really worried.

The law says that an I-864 must be sufficient both at the time it's submitted, and at the time the immigration benefit is granted; i.e., when the green card is approved. Many K1's end up having their I-485's sent to the California Service Center, and they end up being approved without an interview. In that event, you'll never have to prove that your I-864 is still sufficient when the green card is approved. If you do happen to be scheduled for an interview then the IO is probably going to want to see a recent letter of employment or other evidence that you're still employed. If you haven't found another job yet, and you can't provide them with the evidence they request, then you can submit an I-864 and supporting evidence from a joint sponsor at the interview.

I have found a new job. It has been exactly one month since my wife did the biometrics. Does anyone know what's going to happen next? I believe we will be getting a letter shortly from USCIS letting us know the date of the appointment with the USCIS officer.

Congratulations on your new job! You're right that the next step for your wife will be an interview appointment letter, but it could be considerably more than one month away - the time is variable and unpredictable. You don't need to submit anything now regarding your new job but you should bring a completed I-864 or I-864EZ with the updated information to the interview with your wife, in case the officer asks for it.

Updated information would be a new employment letter on company letterhead and paystubs. I would wait until you receive an interview appointment letter as some AOS do not get to have an interview.

Good luck,

Dave
