My fiancee is British and I have heard conflicting reports on when a work permit is issued once the K1 is approved. I have heard his passport will be stamped w/ a permit when he enters and also that it takes 3 months after we are married. Can anyone clear this up for me?

If he enters the US at JFK he can ask for a temp work permit (JFK is the only POE that seems to be still issueing them)... this is valid for 90 days from the date he enters.... At the end of the 90 days he will have to stop work....

once you are married he can file for a 1 year EAD along with his AOS it will take between 70 - 100 days to get this... if he gets it before the temp EAD expires then he can carry on working, but most people have a gap between temp EAD and 1 year EAD..

Hope this helps

Kezzie

In rare cases the Port Of Entry will stamp the visa with a temporary 90 day EAD as in JFK airport, most others dont. File for EAD as soon as possible.

K-1 visa holders can get SS card as soon as arrive in the country without EAD, read the guide about getting SS card and EAD.

limah,

Somebody asks this question daily. But as CherryXS points out, the answer does not apply to your husband.

Somebody asks your question almost daily also, perhaps you will be today's questioner.
