Hi!

Just a quick question so my Fiance and I got a better understanding of how to handle the situation. Currently, his K-1 visa received a 221(g) since he got a case that is currently under provisional dismissal. Per Philippine law, the case is under provisional dismissal for 2 years until it receives a permanent dismissal. Given that we still got one more year to go and despite the fact that he was wrongfully accused (which he did say to the consul and I emailed the USEM regarding this case) and we're still going to try the consul to issue a K-1 no matter how futile it may be. The consul kept his passport after the interview and asked him to forward the court transcripts and records as well as an NBI letter of explanation, which we are in the process of fulfilling. My concern is, given that they will sift through the court records, I assume that this would take them months and our case will be placed under Administrative Processing, which is all great since we are trying to buy time since it will take another year for the case to get out of provisional dismissal. How long does it usually take for an AP? Also, if we did get denied, how long do we have until we can re-appeal, hoping that the case would have been permanently dismissed by then?

Any input is very well appreciated.

Being put in an AP really depends on the case how long it will take. some just one day, 1 week, or a month, maybe year/years. it just really depends on the case, try calling the USEM to get the status of your papers.

Being put in an AP really depends on the case how long it will take. some just one day, 1 week, or a month, maybe year/years. it just really depends on the case, try calling the USEM to get the status of your papers.

As I mentioned above, we have yet to submit the additional documents. I just want to a get a preview on how long does Manila usually handle these cases. I've done a bit of research on this matter and usually minor stuff only take a few weeks while some take months! Yikes! :blink:

Submit the documents as fast as you can. The sooner you do, the sooner they review your case and approve or deny your visa. The fact that they kept his passport is a good sign though.

yeah he must submit it as fast as he can so that they will issue his visa soon too and I think it wouldnt get into AP coz for sure they will contact you soon too, I had a friend and she only required to submit NBI just like your fiance and then after a wek tUSEM issue her visa.. so goodluck and pls dont worry you will have your visa soon
