Renewal of I-765 and I-131 while AOS is pending

Hi fellow Journey members,

I have a quick question regarding the renewal of my I-765 and I-131. Filed my whole AOS to Chicago Lockbox last year (10/19/2011). Received the new EAD and Advanced Parole card (one document) at the beginning of January and in the interim my case was transferred to the California Service Center. Pretty smooth process so far except for the massive delay with the AOS approval. I called USCIS in early October and got a notification a couple of days ago that they will work on my case in an expedited fashion now, since my case is past due standard processing times.

I should have followed up way sooner, but I am little concerned now, that my EAD will expire before I will receive my GC. To be safe I wanted to send out my renewal application for the both (765 and 131) this weekend. Some questions around that:

-Will I have to include all supporting documents that I included in the initial application?

-There is no renewal box for the I-131. Will I automatically get an extended I-131, since the EAD and Adv. Parole are on one card anyway (in my case) when I file for I-765 renewal? Or do I need to go ahead and fill out both?

-Is it sufficient if I includes colored copies of the EAD card (front and back) as verification?

-Will I need to resubmit pictures, etc.?

Thanks a lot for any help on this!

Best,

Alex

You need to follow all of the original I-131 and I-765 requirements (pictures, documents, etc.).

You should enclose a copy of your I-485 NOA (the I-797C) to show you have a properly-filed AoS application pending, and be sure to include a copy of the front and back of your current EAD. You will need to include an I-131 if you want to apply for AP, it won't automatically just happen if you enclose an I-765 only, despite you having a combo card at the moment.

There is no fee for any renewal of either, the same way as there was no fee for them for the first time around.

You should file for renewal 120 days before the expiration of your current EAD.
