Hi,

I recently married a USC in New York. We are living in NY, but want to move to Los Angeles right away. Currently my wife has a job in New York, and she can use that for the affidavit of support. But if we move, she has to find a new job in LA. So will she still be able to use the last tax year to prove her income along with work history at the NY job? should we just stay in New York until the AOS is completed or submit the forms, move and transfer the case?

Current employment is more significant than last year's taxes. They will most likely ask for an updated employment letter at the AOS interview.

She will need income as well as tax returns to fulfill the I-864 requirements. Without a job she will need a co-sponsor. There is an income requirement that has to be met and tax returns from last year won't meet it.

If you don't need to move right away it really sounds like staying in NY till you get your GC would be the best bet ... You really don't want to add even more delay in this whole process ...

Did you arrive on a K-1 Visa or just arrive normally and then marry ?? The reason i ask this is because the K-1ers who are being transfered to CSC are getting their GC rather quickly (6-8 weeks from transfering to CSC) ....
