Letter of Intent question

I am putting the i129f packet together to send off int he next couple days.

Do beneficiary and petitioner BOTH do a Fiancee letter of intent? He is the American and obviously already lives there.

The example/sample letter says " i intend to do so within 90 days of my arrival into the US using the K-1 visa."

But that does not make sense since he is already there? can someone clarify this for me? does he do a different letter? Or none at all?

Yes, both have to write a letter and his will state something like "I intend to marry such and such within 90 days of her arrival in the US".

Yes, it is a requirement of the K-1 visa, refer to page 2, item 5b, of the Form I-129F instructions:

It might be a good idea for you to review the entire instructions to make sure that you didn't miss anything else.

You both need to do a letter of intent, because it states that you are willing to marry each other. This is one of the requirements of the petition. For the petitioner's letter of intent, it just needs to say that he is willing to marry within 90 days of your arrival to the US. Mine said:

I, Anthony XXXX, do hereby state that I am legally able and willing to marry Nancy XXXX and intend to do so within 90 days of her entry into the United States.

You both must do an intend letter! For the Beneficiary the letter will apply " i intend to do so within 90 days of my arrival into the US using the K-1 visa." For the petitioner just remove the " i intend to do so within 90 days of my arrival into the US using the K-1 visa." because he is the American and lives in the states and isn't the one getting the visa... Therefore he will just write he is Free and willingly to marry.

Tell you what: at the time we filed the I-129F paperwork we had not found this great website, so we were creative and did everything our way. We did not write anything to the effect of "I intend to marry within 90 days of entering the US on a K1 visa", but instead we wrote a long (2 or 3 pages) letter in which we explained where we met, how we went through the highs and lows that a long-distance relationships entails, and that regardless of all difficulties, we had found each other and we were ready to get married and spend the rest of our lives together. When I read that we had to spell out the 90-day requirement I freaked out for a few months, until we were approved without RFEs. But yes, we both sent a separate statement.
