Okay guys first of all thanks,I took divorce when I was in Australia, Divorce was based on sole application. Now they want me to explain circumstances under which I gave divorce to my ex.

Is this question is related to my old petition or new petition or both?

This is related to your old application, and under normal circumstances, would be irrelevant to your current one.

Here's the catcher, if you got married back then solely for immigration purposes, you are ineligible for the current visa too. Faking a marriage for immigration purposes is a felony and carries a lifetime bar.

They are looking into your old marriage to see if there's evidence to believe it was not genuine.

If they make a finding that you were married solely to receive immigration benefits, you are ineligible for this current visa as well based on fraud.

Hi guys I need help please,

here is my refusal sheet. Now how can I apply for waiver? where can I apply? And what I need to explain, they only mentioned section 212(a)(6)©(I). How can I know what are the facts which they think I have misrepresented?

212 is for misrepresentation. Waivers can be tricky business! There is a sticky at the top of this forum that explains some of the issues, but at this point I think it behooves you to start researching at immigrate2us.net. That site is chock full of people with waiver issues [whether due to overstays, entry without inspection, misreps].

Also, there are attorneys that specialize in waivers including Laurel Scott who has an open/free chat session on Wednsedays on her site. Google her.

As to what the misrep may be - I would go through every single shred of paperwork ever sent to USCIS or the consulate by you, your mom, and your ex and see if something jumps out at you. Unfortunately, you do not have access currently to what was found during the home investigation - maybe something was found out then that the older [your mom's] file contradicted but was only researched now that that case is active?

Hi guys

I'm in big trouble, previously they only mentioned section 212(a)(6)©(i) with waiver, but, when I inquired about the basis of findings they added one more section 212(a)(6)(E)(i) with no waiver. please guys need help I have not done anything related to smuggling. we can say fraud part is because of my previous marriage, but from where this smuggling part came? there is no derivative in my case not even in previous case.

Is there any way to challenge the findings?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

After nearly 3 months from my refusal date, INA 212(a)(6)(E)(i) is removed, It was just an error by consulate. Now I can continue with I-601 waiver process.
