When my fiance got his passport about a year ago they switched his first name and middle name. So that's how I put it on the forms for the k1. I'm almost ready to mail everything but now I'm hesitant. Because he doesn't have a birth certificate. Just an age declaration (or affidavit?) Which he will need to use to get his birth certificate. I'm afraid the names won't match (birth cert and passport) Please if you know how Lagos is, which one should we fix? How should we fix this problem? Anyone have a similar experience?

Aside from the age declaration he Wud also need to get an ATTESTATION OF BIRTH from d appropriate authority. I don't have a birth certificate too but went to court to get my age declaration then with that I used it to get my "ATTESTATION of BIRTH". I think u shud follow the way the names are in his passport. GOODLUCK

But the passport is wrong. Every other document and school record has his first name then middle name. Even his age declaration. So will the attestation and birth cert when he gets them. He says the passport doesn't ask first name, middle name. It says "given names". So maybe it won't matter that they are switched around. What could happen?

We didn't go through Lagos BUT had a sort of similar situation. My husband has 5 names and they only put the first 3 on the birth certificate (so it looks like one of his middle names is his last name!) His dad's name on the birth certificate is listed in the incorrect order, also making it look like his middle name is his last name, so you couldn't even just assume that his last name would match up with his dad's. On his passport they have his first 2 names and then his last name, so that's what we've used on everything. Birth certificate doesn't match. We haven't had a problem yet and we are in the process of removing conditions! Hope that helps ease your mind a little bit...

Since the names is virtually same only switched round..I think it won't be a problem as long as u don't add any extra nameto whtz been switched then I don't think it's a problem.when filing file the exact way the names come in his previous owned docs.GOODLUCK

Well this is what we decided to do... and pray a lot.... we are going to write his name on all the forms the way it is suppose to be, the way its on his school records, age declaration, and eventually will be on his birth certificate. We are leaving the passport as it is. He pointed out to me that the passport asks "given names". It does not ask "first name" or "second name". We are hoping since the names are the same and spelled the same that it won't be a big deal that they are switched around. They ARE his given names. If we try to change the passport now, yes, someone may think we are trying to do something shadey. I hope this will not cause a denial and if they don't accept it, I hope they allow us to get a re-issue with corrections.

This post is fairly old but I felt the need to comment. Everything, from the birth certificate, to the passport, to the visa application MUST have correct names, birth dates, etc. Any deviation of this information can not only cause a visa application to be denied but also can cause denial of entry into the U.S. at port of entry. If the passport information is not exactly matching to the birth certificate then you will have problems when (if) he enters the U.S. He will need to provide birth certificate and passport information for I-485 Adjustment of Status, for Social Security number, etc. It all must match, there is no way around it. Have the passport corrected before copying it and submitting it with the visa application...this will save you a lot of heartache with additional wait times and possible denial of visa application.

In response to the passport showing given names but in wrong order, when you receive the passport you are told to review the information and return the passport if anything is incorrect. You are not going to be blamed for the mistake or look suspicious, the information is wrong and can be corrected by providing the documentation again when you send the passport back for correction.
