I recommend you re-apply as a CR-1 visa and give them a brief written explanation of your denial and explain them it is cutom in your religion to have a marriage certificate issued or whatever the reason is so that you can be on the safe side cuz immigration will know if they pull record that you were once rejected so its better to let them know in advance rather than wait and get denied again. Also you shouldnt have sent marriage certificate in first place if you applied for Fiance, it had to be rejected - common sense!!

They already filed the I-130 petition but based on the answers to the question about marriage date, it should result in an IR1, not CR1 visa BECAUSE the marriage was more than two years ago.

Facts are cheap...knowing how to use them is precious...

I know we shouldnt have submitted it with a marriage contract but my lawyer said it would be better not to hide anything from them, but now what.worries me is I put the date of our wedding reception as the date.om the i130 not the date of our marriage certificate.

So at what point did they deny you? How did they find out you had that unofficial marriage certificate? The reason I am asking is because my fiance and I are Muslims as well and we were thinking of doing the unofficial marriage certificate. We haven't received our NOA2 yet. So we were wondering when the best time to do it is. How do they find out about the marriage certificate? Did you show it to them? Did you ever receive an NoA2? thanks for your help.

from what I went through my thoughts to you would be go with the spousal visa but.if your marriage certificate isnt registered with the court then you should be good with the fiance visa my problem happenes at the consulate I did receive a noa2 fast but the consulate did not give us an interviee because they thought we were married even though we.wrote a letter explaining our tradition.

i am curious about this too - i beleive in the Muslim world ( someone pls correct me if i am wrong) once you sign your marriage certificate ( katib al kitab) then you are officially married. Whether the marriage is consumated or not.

I guess it depends on the person but in my case and most Palestinians cases when you sign the katib iktab until the ceremony you are just engaged.

Now im worrying about the fact that on the i130 I put down the date of our wedding reception not the date on the marriage certicate. What do yall think I should do about this should I call and explain everything to them, im trying to avoid waiting longer than I have to with this process.

We are muslim and signed our marriage contract on June 12th and our ceremony was June 23rd and I used the June 12th date on my application because I was told that the USCIS will look at the marriage certificate and use that date of issue so that is the date I used.

I would guess they will also use the 2009 date for you too.

If it were me I would not call or send anything unless I got a RFE. You can always write a letter of correction and send it in with the NVC paperwork if USCIS approves it without a RFE.

If they ask I would just say that you considered the date of ceremony your wedding date and did not realize you should have put the 2009. Hopefully that answer will suffice for them :)

Ask your fiance how he would feel about his sister entering into an "unofficial marriage," then decide if it's the right choice for you.

it doesn;t matter what your country or culture does. The embassy considers the day you sign that contract as the date of marriage, consummated or not.
