Hello again. Here is a recent email I got from my lawyer at FastK3. Everything they tell me contradicts what is said in this forum, which concerns me........... The first part is what I wrote a whole week after they said they would get back to me as a follow up. The 2nd is FastK3's reply.

FastK3 responds:

"I've been checking with fastK-1 and have concluded that if you focus on the I-129 and follow their instructions, everything will work out. Thanks, ****"

What a shallow answer, it looks like FastK3 will just move the process along however they want. I dont like them and I dont recommend anyone use them. I have had multiple stumbling blocks with them since I hired them. I know everything will work out, but I want to do whats best.

from your timeline... you have lost 2 months processing for your k3 due to the mixup with the NOA, with your I130 approved lets say you work off this timeline...

start the I130 through NVC complete in 3 months goes to embassy and you do not need to do further processing in the US.

K3 through processing in 3 months goes to embassy, then you have to AOS here in the States..

Just my opinion, do the I130 you will be better off... oh and fire your lawyers.. they should of been on top of this ages ago..

THanks for getting back! Here is a most recent excerpt from an amail reply I received last night. (FastK3)

"It would be highly unusual that the CR-1 should be approved before the K3.So my suggestion would be this: We follow through with both processes(K3and CR-1) and then simply go with the one that gets approved first. If youreally get an interview and approval for the CR-1 visa first, you can usethat for your wife’s immigration. But we should also continue with the K3process to avoid any risks of having to wait very long for the CR-1."

As far as errors go they have never gotten back to me when they said they would. Not once, not even the owner and other partners. The biggest error was telling me it was ok to leave the country and go back to my wife, that I can submit a temporary change of address with the postal service. I did that and came back to the Phils and never received my NOA for the I-130 which was needed to send the I-129F. NOA was returned to USCIS as undeliverable. That mistake cost us 2 months at least. The lawyer sent off the I-129F only after I sent them the I-797, which, as you can see from my timeline was just recently.

It's been super frustrating and they have been hard to deal with. I'm anxious to see what you have to say about the comment they left last night. Thanks again.

In short. You have received a case number for the I-130 at NVC. The NVC process will take 2-3 depending on how smooth things go. Once the case is complete and forwarded to the embassy/consulate, the I-129F/K-3 becomes void as the CR-1 over-rides. With the interviews taking as long as they are in Manila, even if your I-129F for the K-3 is approved and sent to the consulate prior to the I-130 case complete at NVC, chances are more then good that the CR-1 case will arrive at the consulate prior to the K-3 interview. Do the math.

The comment makes sense if the I-129f is submitted promptly after the I-130 is submitted. There's a high probability that it's a waste of money if the I-129f is not submitted until after the I-130 has been approved.

Unless, of course the I-130 follow-up at the NVC is slowed by not responding to their mailings in a timely fashion. Since this outfit that you're using doesn't appear to be a rapid responder, perhaps their statement is correct because they cause it to be so.
