Proof from past I-129f available to consular at marriage interview?

  • Jul 27th, 2012 - Packet 3 Received
  • Sept 5th, 2012 - Interview (approved)
  • Sept. 7th, 2012 - Visa Received

I was really curious to know, if we applied in the past for a k-1 visa, do they send all the past proof along with the new proof we sent with our I-130?

I know there will be a record of what you submitted before. I am sure they still have your packet filed away somewhere. But I would advise you to start your new petition fresh. Act like you never sent anything before and build the packet from the beginning of your relationship until now. In other words let your packet tell your love story :luv:

It would be a good idea to make sure you know why the K1 was denied and make sure you have proof pertaining to that specific issue. Best of luck!!

The only answer the senator's office could get was lack of proof of a bona fide relationship.

It really was our fault, we were very naive and didn't send in enough proof to back up our case.

I had only been to Morocco once to visit him and then applied for the fiance visa. We met online in August 2009, I went in March 2010 to meet him and applied for the fiance visa in July 2010. Neither of us knew anything about the difficulty in Morocco with fraud.

I was angry at first, but now can see that we weren't prepared and didn't have a strong case.

My husband (fiance at the time) was pretty poor at english, if someone spoke slowly he could understand,

but he interviewed with the blonde woman and she spoke very fast, there were many times he didn't understand

what she asked him and she wouldn't say it slower. He was very intimidated by her . Since then he has been taking classes at the American Language Center and is doing well, preparing for when he works here.

After he was refused his visa in Dec 2010,I went to Morocco again in Feb 2011 to be with him , and returned

to see what administrative processing would be done as they said they would contact me. As you all know, that doesn't exist for fiance visas returned to the U.S. After waiting almost another year, I returned

and we were married in March 2012! I have built our case this time with a lot of proof and hope that we won't be denied again! I went to see a lawyer for a consult, she happens to be the vice president of the immigration lawyers association and does workshops at Vermont INS, I told her that we have a 10yr age difference (i'm older) and maybe they were biased about that , she took a look at our photos and said no its not that. It's just Morocco and visa's are very difficult because of the fraud :( Thats our fiance visa story...I take full blame for the denial, not prepared and thinking it was as easy as handing in the paperwork and small amounts of proof.

Our love has grown and along with it, a mound of proof!

Yes! Great job in making sure you took more trips there and got married before you filed again. I would just make sure if you didn't front load your petition that you have everything and anything under the sun to back up your petition ready at the interview. I think the longevity and number of trips and you guys sticking together after the denial which has made your love stronger is a good thing and I feel is very positive for your case. Good luck!!

Yes! Great job in making sure you took more trips there and got married before you filed again. I would just make sure if you didn't front load your petition that you have everything and anything under the sun to back up your petition ready at the interview. I did front load our application with a lot, I feel I did a great job and had a lawyer look it over for anything that he felt was missing that I might have overlooked. I feel confident in presenting our case, I wish I could predict there decision , it sure would alleviate my stress level! Give yourself credit you have been at this since meeting him in 2009 too! When you frontloaded your application did you send your marriage cert? if so...copy of or original?

I sent a copy of the marriage certificate, I will send the original to NVC. The NVC requires all original or certified documents. I'm trying to give myself credit, we are doing everything possible

within our power to bring us together!

Thank you ! I read your immigration story, seems you had a fast and positive outcome. I hope that this time around they

will see that we deserve a visa for my husband also. I think in your case their mistake worked to your advantage , I think its rare that anyone makes it through the first try as your husband was told when applying from a MENA background. Seems the people who do are younger couples! Someone told my husband that even in Morocco, they won't approve the first try on the marriage visa! I hope they are wrong , but if they are right we will have to accept that and keep showing up until they get tired of us!

I'm already planning my trip to see him in February, I need something positive to focus on !

Someone told my husband that even in Morocco, they won't approve the first try on the marriage visa! I hope they are wrong , but if they are right we will have to accept that and keep showing up until they get tired of us!

HA! I think that's the right attitude. I am pretty sure the embassy in our situation was tired of me calling and bugging them so they just pushed him through to get rid of me! Sad when I know them all on a first name basis :wacko:

Persistence is the key! And it sounds like with all the research and preparing you are doing you will be fine this time around. Just remember eventually it WILL happen!! :thumbs:

So if we are denied, they will need to supply a reason to them directly after. The senator's office

doesn't assure us a visa, just that they would be there for support and to let them know they are watching.

I'm glad your senator is on the dot with you, we got the congressman involved, but it looks he's too busy to for us, until too late, i heard that senators can make changes regarding the visa issuance, comparing to congressmen, would you mind giving little details of how you succeed to have your senator in your side? Its actually the senators assistant who is in charge of immigration issues. I got her involved to help with finding out about our k-1 denial. This time she will follow it through until the end with the I-130. If we get another denial , I will have support to know what to do immediately. Last time I couldn't get through on the phone or email until it was too late and it was returned. Just know that they can't change or affect the consular's decision. It's just good for the consular to know the senators office has an interest in our case.
