Hello,

My wife and I have applied for AOS and we have a date set for the biometrics. I am here on the K-3 Spouse Visa. I have some questions regarding the interview process.

- How long does it usually take to be given an interview date after the biometrics appointment?

-Are you given a choice of when you can have the interview date, like the biometrics appointment?

-And is it okay to travel outside of the US before the interview date?

I do not know about questions 1 & 2 but I can tell you that you cannot travel outside the US without advanced parole prior to receiving either your 551 stamp or green card. If you do you will be out of status and risk not being allowed back in. I believe that advanced parole info is in the guides. Good luck with the rest of your journey.

On the K3 you can leave the US multiple times until the visa expires. You do not need the AP.

Concerning the Interview, I don't know. I had my biometrics in June and have not heard anything since then.

Jan 5'07 - Interview Date - approved

Jan 5'07 - CRIS email: welcome notice mailed

Jan 10'07 - CRIS email: Card was ordered on Jan 9'07

As far as how long will it take for an interview, check out this website, and just put in the district office you are going thur, and it will give an est. of when to expect an interview, each district office has different waiting times.

You should know that the K-1 and K-3 Visa are different in this aspect ... K-3ers are allowed to travel back and forth on their visa where the K-1ers are not allowed to without AP or the actual GC ... Atleast that is how I understand it from other VJers ...

Mellaliya,

The K3 visa is a multiple entry visa. If you read the instructions for the AOS (I-485) it tells you that the exception to getting the AP is the K3 visa holder. Also on your visa you will see that under the 'Entry' tab it shows the letter M (multiple).

Can I Travel Outside the United States?

If you are in K-3 or K-4 status, you may travel using your unexpired K-3/K-4 nonimmigrant visa to travel outside of the United States and return, even if you are applying for adjustment of status simultaneously.

Usually for a K3 it takes quite a few months to get an interview. You are not given a choice of an interview date, however, I believe that you might be able to reschedule with a good reason... others will be able to answer..
