Folks, you all must be wondering what the heck is this OOS now ? it is not another fancy Immigration term but i am using this as an acronym for 'out of status'.as far as my question is concerned it is fairly simple.i am the beneficiary doing AOS (going smooth) from B2. my I-94 is going to expire in November.i wanna fly to Vegas(from Illinois) on new year's eve(my wife's Birthday),i will be OOS by that time but yeah my AOS petition is still pending(which waves off the OOS clause if i am not wrong) and i would be getting my EAD/AP in like few weeks and the interview letter in coming few months.i wanted to know from any personal experiences that if it is ok to fly anywhere in the US while being OOS and having a pending petition ? i would appreciate personal travelling experiences from the fellows who had the same scenario. merci beaucoup

Your time line and information is not complete, please do so for better advice. You can travel in the US on your unexpired I94 and your passport. If you file your AOS now you should have a I797c before January 1. Do your best to get a social and state ID or drivers license while your I94 is valid and travel on the state ID in country with your passport and I797c as backup ID. If you filed for your AOS and have your I797C there are no issues, especially with a state issued ID. While your AOS is pending you are good to go for one year or until it is completed or terminated. Hopefully you applied for a EAD and AP.

If you file your AOS now you should have a I797c before January 1. Do your best to get a social and state ID or drivers license while your I94 is valid and travel on the state ID in country with your passport and I797c as backup ID. If you filed for your AOS and have your I797C there are no issues, especially with a state issued ID. While your AOS is pending you are good to go for one year or until it is completed or terminated. thanks for your input bigdog , i urge you to have another look on my post.i have provided/mentioned everything that was required for my question.one cannot apply for a state id , regular driver's license until you have your EAD/AP card.

well, I will let you know this friday as we are in the same situation and I didn't even think about it before I booked a flight for my Hubby and I. We are flying to atlanta and he is in the AOS process from k1 visa. We applied for AOS about 6 weeks ago but he hasn't received his EAD or AP yet. His 1-94 is now expired . He had taken the Missouri driver's license exam and passed and was issued a temporary license. We got a letter in the mail saying the temporary one is no longer valid since i94 expired. I booked the tickets before getting this letter. He has his social security card - but that is not a valid picture ID which is what he will need going thru security. I am planning on him using his passport and bringing I797C .... Now I am worried that this will be a problem. I too would love any input from someone who has experience with this...

You are in a temporary period of authorized stay while your AOS is pending. Chances are even if you were just flat out out of status you'd be fine because TSA isn't typically looking for visas, but you should definitely be okay with the I-797. Just make sure to bring a copy with you when you travel, just in case you are asked.

You are in a temporary period of authorized stay while your AOS is pending. We had no problems at all traveling this weekend. We were so worried - we brought along our i-797 receipt - just in case - but it was never needed. They never looked at his visa - only looked at demographics page of passport - :)
