Hey all!

I am a newbie here.I am from the states,have been in the UK off and on since last Nov,with the visa waiver program.I had my fiancee visa approved in the US in mid may,and headed over in June.A family illness had me on a flight back to the states nearly a week and a half later,and I returned here in July.We were married in Sept,and have made the big decision to go back to the States,do to so many reasons,mostly elderly parents.Anyway,I know I can do DCF,if I have been in the UK 6 months,does that apply from my visa approval date,or the date I got here in june,and next question is this,since I had to return for a emergency,does that mean they wont count my June arrival date,or will they count my July re-entry date?I know it must be 6 months before I can apply right?

Wheww....next question,I know I wont meet the financial sponsorship allowance,I am hoping that my Uncle in the States will co sponsor,as he is a very wealthy man...granted that he will do this,there shouldnt be a problem with sponsorship for my husband should there be?

Also,are transcipts of my taxes acceptable?they wont need notarized or certified will they???

Sorry about so many questions,just scratching my head with all this paperwork.

The DHS office on London has set the requirement at six months minimum residence in the UK -- both legal leave to remain permanently and actual residence.

That's from http://britishexpats.com/wiki/DCF_I-130_Filed_In_London not a government site but another one that assists in the process. Did you receive legal leave to remain permanently in the UK? It sounds to me like you were only there on visa waiver? If so, it doesn't sound like you qualify.

Sounds like your JUne arival date may count, as you were on a visa then. A quick trip back to the USA is fine, people travel, but you must be legally resident in the UK for 6 months.

Yes, your uncle co-sponsoring will be fine.

Transcripts of taxes are fine.

Your domicle is a mbit thin but considering you haven;t been in the UK long, should be ok. Do you still have a valid drivers license or voter registration? Maybe a US cell phone bill?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I got legal permission to come over in may,through my marriage visa.

Valid US driving license,valid health insurance cards,bank account,no cell bill...but I am registered to vote as well.
