Renewal EAD... Scary situation...

PROLOGUE:

The wait for a permanent residence interview continues. As some of you know, we filed last summer (the whole package - EAD, EAD and AP). The AP came in November, and the EAD finally came this May, but it was dated effective 10/25/05 to 10/25/06. (We had no clue why, and never got a decent answer through the disinformation line.) Then we got an AOS interview appointment in April of this year, but they sent a cancellation notice two weeks later and never sent a new appointment letter. Hisham's been to two Info-Pass appointments in NYC since then, but they've never had any new info. And so we wait.

Anyway.

THE REAL STORY:

Meanwhile, at the beginning of this month he was offered a promotion at the job he got earlier this year (while he had a valid work card). When we realized that you have to send the original work card with the renewal application, we decided to hold onto it for the next couple of weeks, until it expired, since we didn't know when training would begin and figured they would ask to see it then, and since a coworker of his had commented that photocopies don't count. (That is, if they ask you to show a work card, she said, it has to be the real thing, they don't accept photocopies.)

Now today his new boss told him to bring a valid work card on Wednesday (when he goes in for a new training program for the promotion). We mailed the renewal application last week, so the original card is now gone. It was expired as of the 25th of this month anyway.

When Hicham told him earlier today that he didn't have the new one yet, the boss freaked out. He asked if Hisham at least had an I-94 with a work stamp. Hisham said yes, because he DOES have an I-94 in his Moroccan passport that's stamped and says that he's valid for parole until January 18, 2007.

But today, when Hisham got home and told me about it, I grabbed his passport to check and I saw that his last I-94 (from a trip he took with his AP) doesn't actually say WORK authorized until January 07, it says PAROLE authorized until 1/07. So then it was MY turn to freak out...

CLIMAX:

I'm currently trying to schedule an Info-Pass appointment for tomorrow or Wednesday for him, because he NEEDS that renewal NOW, or else he'll probably get terminated (let alone losing his promotion) on Wednesday, because I'm really scared that "parole" probably doesn't mean you can work...

Are walk-in renewals typically granted on the same day...?????

Yes a scary situation, working with out authorization.

EAD is issued "valid from the date of decision" and does not retroactively go back to the expiration date of the current EAD, if you are renewing EAD. If there is a gap between two EADs, and if the applicant works during that period, that would be considered as an unauthorized employment.

Hi Elizabeth. I'm sorry I don't have an answer about the walk-in EAD renewal. But something that confused me is this:

Unless there was some kind of new update to the EAD renewal forms/directions, I don't find it saying you have to send the card in.

When we filed to renew Sujeet's EAD, we sent the renewal application 3 months before the EAD would expire(which was a waste of money since the GC was approved before the EAD expired. But it's always better to be safe than sorry).

You only have to send a photocopy of the front and back of the EAD when you renew. See these instructions:

I understand... but you would have to check this with more knowledgeable people. That if you get your NOA from the EAD that you sent, you can keep on working. I have read this several times, but I dont have the threads now. If you sent it last week, you should be getting the NOA for the EAD pretty soon.

Try to give that search, and if it is so. Maybe you can get some sort of confirmation information from the DO when you go for infopass.

Just a thought.... might be worth looking into it.

Hi there Christina, long time to see (or type, as the case may be). Maybe I got outdated info or had outdated paperwork, but I'd been under the impression that the original card had to be sent in with the renewal application. I'm currently looking things up online. Regardless, the renewal with the card enclosed is already in the mail and gone. That's too late to change; all we have is the front and back photocopy that I saved in our files. What I'm desperate to figure out is how EAD renewals work in person; do USCIS district offices typically issue any kind of stamp/evidence/receipt approval in person at a walk-in EAD renewal infopass appointment...?

Looks like Hisham may have out-foxed himself by not applying for renewal of his employment authorization several months ago, when he should have given that the AOS was uncertain. Even if the employer did accept photocopies, the photocopy would show that he's no longer EA.

Thanks, Yodrak. But there's no such thing as walk-ins for EAD renewal? What do people walk in for, then? (He's gone twice trying to get further AOS info, trying to figure out why they cancelled our April interview and what else we should do, but they've never been able to tell him squat. Just wait. We already did the biometrics last November, almost a year ago, so what else can they want? And why was the EAD we got in April dated 10/05 to 10/06 instead of April to April for crying out loud?!)

Not annoyed at you, just annoyed in general... Walk-in infopass appointments have been a total waste of time and money for us then. That's truly disturbing.

I was pretty pissed off to learn that hubby's EAD was backdated 2 months due to it being *approved pending biometrics*. I threw a fit when i saw that. Unfortunately, this happens frequently. Yours is even more extreme as far as backdating.

It used to be that you could go to the local office to get an interim EAD (that was essentially nixed 9/1/06) however I do not believe a renewal can get an interim... moot point anyway, but this is what you may be thinking about as far as help at infopass for EADs.

Have you contacted your elected officials re: AOS application? You have got to be way past the processing times by now. Thge only thing I can think of is Hisham got a name hit and they are trying to clear it prior to the interview. In our case we had the interview anyway.

I've emailed every single elected official I can think of... and just sent out an 'urgent' update... we'll see what happens. I once had good luck when I lived in Indiana (and LOVED senator Lugar and his office) but have yet to hear a word from anyone in New York. Here's to hope.

Ha... I just reread your post and counted back the months. We got his EAD (which was dated effective last October 25, 2005) in early April of this year, 2006. At that point, it was already 6 months old. We might as well have applied for a renewal the day after it arrived.

Just posting because I woke up stressing at 3am.

Drafting emails to more elected officials; the first round went out at 8pm.

I hate this process.

I doubt you will find an elected official that will convince USCIS to make an exception to their rules or to make an exception to the current employment authorization requirement. Your failure to renew at the proper time is not going to create an emergency for them. I'm not being mean--just honest. It appears that he will be taking a bit of unexpected time off.

We'll see. I'm not giving up yet. This isn't about asking for any special treatment; I'm just trying to get a sense of what our options are. There are always things to try; we're just going to try them all in the next two days time...!

PS, You don't seem mean, as you said, just honest. And honesty is what we're about too. (That's why I'm on here now.)

Your options are that he stops work and waits for the new EAD..... As it was not USCIS's error it will be processed in the normal manner....
