Timeline

I was married 2 years ago today in thailand to my wife, i got my notice of action august 30th 2012. i have gone to thailand every 6 months since ive been married. I also filed for my step daughter. My lawyer based in chicago told me 6-7 months from notice of action that they would be here. I just got off the phone with uscis and they are telling me a year. Im freaking out right now. ive already told my wife 6-7 months. I waited so ling to file because i wanted to buy a house and prepare for them. CAN ANYBODY FILL ME IN?

Did your lawyer advise you to go the K-3 route vs. the CR-1? The K-3 is essentially obsolete at this point, so if that was your lawyer's recommendation, you may want to give them the boot.

On timeframe, it may help if you fill in your timeline to get an estimate based on the other K-3 timelines before freaking out any further. Good luck!

Your K 3 will be converted to a C R 1 I think. Better anyway because of the green card. Length of your marrige may result in 10 year card.

Seems you got NOA 1. About 6 months to get NOA 2. Then NVC process. Time depends on your ability to respond to them and some luck.

BKK sees about 700 cases per month. They work on immigration based cases two days per week. Yours will be one of them. This can cause a delay in getting the interview date. Could be 8 to 10 months in total.

The child concerns me some. Do you have the release letter from the Bio father or a Thai court order to present to the embassy? Release letter must be in both languages and signed by father. Father is sometimes asked to interview at embassy as well.

The father has seen the daughter only time in life, i was under the impression i need a signiture, called him and asked and he wanted a large amount of money. my wife took her mom and aunt to thai courts and they took custody from him. Thai embassy issued her a passport. my lawyer called us embassy and was told that as long as thai embassy issued passport that they would allow it

In a case I know of where two kids are involved that have passports the embassy has refused to grant visas. Its been two years now. The mother also had a Thai court order but the embassy wouldnt honor it. The father couldnt be found. I dont know anymore details.

This is always a difficult subject and situation. Please take the time to inform the members of how this goes in your case. We hope well of course. If so it may help to inform others of what has been accepted.

I hope you arent serious. While what I told you is true its also true that there are recent cases where the embassy granted visa to children with exactly the circumstance you describe.

The couple that couldnt get the visas didnt take the time to try to explain exactly why they couldnt. These things are always truly unique in scope so your case may have no problem at all. The embassy continued to say they hadnt done enough to find the father even though the Thai female tried for months.

In the case above the couple used a Thai lawyer and spent thousands of dollars but to date have not gotten the visas. I dont know why the embassy rejected the Thai court order. Not long after that event another V J member wrote to say they had a very similar case but the embassy allowed the use of the Thai court order. Thats the first case I know of where they accepted the order. Its been done several other times since then.

You say you contacted the father. The outcome of that is standard Thai extortion. The embassy will probably ask what contact attempts were made. The fact that he is able to be found will become a factor. The question is if the embassy will honor the Thai court.

When i got married, I had thought the signiture wAS THE ONLY WAY to go. So i never filed for the visa. Hired a private investigator to find him and ended up finding the mother. She got us a phone number and said everything would be alright. We contacted him and he said he would sign, SO than i hire a lawyer and a notary to go to Roi Et to meet an at undisclosed location. A women calls the lawyer and says he isnt signing anything, Turns out he was just married. SO for 6 months i sent my wife and mother in law to Surin at least 6 times who told us he would sign the paper. the lawyer wanted 6000 usd and said it would take a year to settle, the fathers wife would answer phone and say 1,000,000 baht and he will sign. so naturally, im about to lose my mind. i told my wife to take her entire family to the moms house and not leave until they got a signiture. so before this happens my wife decides to go to amphur, and for 300 baht they get the paperwork to get the passport. I wouldnt let my wife leave the amphur until she was fully convinced this is acceptable. she laughed at me on the phone and said we were fine. than the immigration lawyer in the us emailed the embassy and after 9 days got the response that we were ok. So at this point I hate my lawyer anyway. as for my daughters father, as you can imagine, i have no words to describe my feeling for him other than I had almost convinced myself a death certificate was the only way to go. so im about 15lbs lighter and have much gray hair and am losing hair over the coarse of the last year. all of the bribes and attempts at extorting me have left me crazy. Im just nervous because i had finally let go of this issue in my mind and am terrified of dealing with him again. and no my only way to get ahold of him is a neighbors phone who was doing the bargaining for him when we last left off. One day i hope to get them here. I just came back yesterday from a month long trip to see them and for the first time was able to talk to my daughter in english. she knows me as her only father, ive been with them before she could talk. I just want my family as fast as possible. I feel like an old man and only 35. and by the way, my wife was never married before if that matters, but my daughter has his last name.

The problem is an Americans view and understanding of the way things are in Thailand. My husband had to deal with this as well.

You would have been better off if you had know to turn to V J for advise at that time. You put demands on your wife that caused the situation to become worse but this is understandable. These Thai men; fathers are simply pigs with clothes on.

The method used by Thais in these matters is always the same. We NEVER approach these things head on. NEVER. We always sue the neighbor or someone to do the dirty work. We believe or say we believe in saving " face ". In doing this we save ourselves the trouble of accepting the responcibility we should have for our actions. We run from what we fear which is really ourselves.

The extortion attempts are simply part of life in Thailand. We have ways of dealing with these things that dont include death certs but can be effective in eliminating the threat. Sometimes the person must be convinced they have to accept a resonable amount or nothing. This is a difficult game to play especially if you arent aware of the rules. An American baseball game can be seen as children throwing a ball around or as others see it as a game of strategy.

I love to see you refer to the child as yours. My husband did the same from the begining. This child will come to know only you as her father. This will be what you intend it to be no matter what it takes. Do not give up nor allow yourself to be beat down by the events as they unfold.

I certianly dont mean to make you feel as though you will fail. I am simply offering info and insight I hope. Also I ask you again to help inform all of us as the case moves forward so others may benefit. I hope very much to find that the embassy proceeded using the Thai court order.

Your wife never married because if we marry these pigs they may have legal access to anything our family has including land. Thai laws are written by men to protect men. The women are seen as baby factories so that the kids can be educated to know how to feel responcible for taking care of the men later in life. The fathers name is on the birth cert to protect the child leaglly.

It may be a good idea to find the book " Thailand Fever " on Amazon to better understand the Thai thinking on some matters. Your wife can find the book in Thailand as well.
