Hello VJers,

Pretty simple questions.

1) Is there a interview when adjusting status from K1 visa process?

2) I already got her EAD & AP approved and got the card. But for some reason on the USCIS website, if I check from the I-485 application it's status still says "Acceptance". Not even "Initial Review", should I be worried and contact them? or it's just the way they it it till they approve it?

Appreciate your help.

Hello VJers,

Pretty simple questions.

1) Is there a interview when adjusting status from K1 visa process? Usually, but there are exceptions, check the family-based AOS forums for more info.

2) I already got her EAD & AP approved and got the card. But for some reason on the USCIS website, if I check from the I-485 application it's status still says "Acceptance". Not even "Initial Review", should I be worried and contact them? or it's just the way they it it till they approve it? Realize that there is apparently a real processing backlog at this time, you may just be stuck in the backlog.

Appreciate your help.

Hello VJers,

Pretty simple questions.

1) Is there a interview when adjusting status from K1 visa process?

Most of the times, Yes. But it depends. f your case its send to a local office, you will have an interview, but if your case is transfer to California service center, you avoid the interview. Although, since August 1st, all the Adjustment packages are now process by NBC (National Benefit Center) and if you are lucky enough you can get your GC without an interview, but the NBC can also decide to send your package to your local office and have your interview there. But cases are not longer transfer to CSC. Check the USCIS NEWS http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c3c7ca7c5fed9310VgnVCM100000082ca60aRCRD&vgnextchannel=e7801c2c9be44210VgnVCM100000082ca60aRCRD

2) I already got her EAD & AP approved and got the card. But for some reason on the USCIS website, if I check from the I-485 application it's status still says "Acceptance". Not even "Initial Review", should I be worried and contact them? or it's just the way they it it till they approve it?

You shouldn't be worried at least for now. Sometimes the USCIS is not the most reliable tool. If you don't have more than 5 month and you haven't been transfered to CSC you shouldn't be worried. If you were transfered, usually takes 6 month or more.

Appreciate your help.

1) Sometimes yes, sometimes not. Prepare documents in case you have an interview. Expect an interview notice OR an approval OR a RFE on your case.

2) It's normal and happens to a lot of people (myself included). The online update system is sometimes "stuck" and so, unreliable at 100%. If you have received a notice of action for your I-485 application, no worries, they have your case.

Andrea&Henry, from OP's timeline, he/she filed after August 1st. So his/her case will either stay at NBC and be adjudicated without interview, or be sent to his/her local USCIS office for an interview.

Yes I know, just wanted to show him how things work then and work now. I didn't check his timeline so I give them the options, just in case
