What did you originally submit as supporting evidences of your I-864?

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

I only submitted my last 3 years tax transcript.

Is this saying that I need to submit those documents or saying that I don't meet poverty guideline

Well, I didn't see your documents so I can't say. :)

But the RFE says both that your sponsor claimed to have a sufficient income but proofs have not been submitted, and that your sponsor's income is lower than 125% of the poverty line. Is that last one right?

You either need to show you currently have enough assets/income to meet the 125% of poverty guidelines for you family size, including the immigrant you intend to support, or you need to find a joint sponsor that meet the same guideline for his family and the intended immigrant.

It is saying the amount listed on your tax return is not enough to meet the requirement, BUT the amount you listed as your current annual income does meet the requirement. However, you provided no proof of the current income amount that was listed and they want you to send evidence of current income such as a letter from your employer and recent pay stubs.

yes.

I think the problem is that my income tax filed for 2011 says that I made $28,500 ,but I put my annual income has $30,000

I made $28,057 2010 tax year also

I also make money exporting cars in my home country and selling them. I have always maintained a high balance in one of my bank account

at some point I have had like $40000. If I show my statement of account showing money in and out of my account will it be enough?

Problem is I have only about $14000 in my bank account,I can only have more money when I sell my cars

please what is federal poverty guideline for 2012 is $28,500 not enough?

How many persons are in your household?

What matter is your CURRENT income. As others said, recent paystubs and a letter from your employer stating your current income, your job title, and details about your position (part-time/full-time) are the evidence that USCIS want to see.

my household size is just my wife and I

we don't have any kids yet

so I presume 2

Send what things they list on the RFE that you can come up with, and you should be good to go. How many exemptions are you claiming on your tax return? Are you paying any child support? That should be reflected on your household size as well.

You need to prove current income, say a copy of your last paystub and a letter from your employer would do it.

Jay-Kay got it right (as usual). You need to send proof of current income. That is, in fact, what the RFE says.

Should I order my tax transcripts again, submit proof of income, and my bank statement ?

No, the problem is without proof of current income, your I-864 cannot be processed. The second part is if you are not able to submit proof of current income. A letter from you employer, stating that you work there and earn X amount, is all you need.

I finally received the rfe in the mail and it is saying stuff about I-864 not meeting poverty guideline

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.
