Hi,

My wife came to the states with a k-1 visa, we got married within 3 months.

I mailed out the AOS form,ead,and authorization form on august 28th .We received a letter for biometrics which she did on oct. 4th

I just checked online for case status, to my surprise RFE" On September 15, 2012, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

I never received any letter requesting for evidence in the mail.The problem also is that my wife travelled back to nigeria for her grandmother's funeral, she was issued an emergency travel document while her advance parole is still pending.

I don't know what the RFE is for

I did not submitted a form I-693 along with the other

I read that it was not needed if medical examination was done before coming to the states

Please help!

You need to schedule an info pass ASAP and figure out what is going on. You get 87 days to respond to an RFE and you're already past 60. If you don't respond by then you'll be denied, so it can't wait.

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You still need to submit the I-693, you do not need another medical examination, but you have to ensure that you are up-to_date on vaccinations. There is a part of the form that still needs to be signed by a civil surgeon.

past 60 days ? don't understand

September 15th to October 15th is one month , today is the 21th which is 6days

that will make it 36 days

I-693, Medical Examination of Aliens Seeking Adjustment of Status.I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy).

This is why i did not include the I-693

Your wife should have gotten a vaccination sheet from the doctor to bring with her to the US. That is what you should have included in the packet.

06/03/2015-Called to get address updated Ar11 online add change didnt work-got infopass for June 10th

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

The vaccination sheet would have come from the medical facility where she received her vaccinations and would be separate from her medical records and immigration documents. Perhaps she did not know what it was, or she may still have it with her records.

I-693 is doubtful to be the issue but anything is possible. As a K1 with a complete medical you don't technically need to submit anything.

it's some other initial evidence which could be ANYTHING. You need to find out what it was and the only way to do that is with the INFOPASS. I also suggest your wife return to the US asap, before the time to submit the information has passed. If you fail to reply on time, or reply incorrectly her AOS will be denied and she will be unable to re-enter the US, even with the travel document.
