**** Duplicate removed- all members here have lives outside VJ and you posted on a Sunday when it is very slow. Give it a day or two for answers ***

1.a. You need a lot more than I-140 and marriage cert. See our Guide here: http://www.visajourney.com/content/i130guide1

1.b. write "none" (never leave a question empty); they understand that when applying for a spouse from abroad, you likely won;t have lived together.

2. See the Guide I linked to above.

Answers:

  • You MUST include copy of your marriage certificate when the I-130 is submitted, otherwise the petition will be rejected for improper submission..
  • For question #21, an appropriate answer is "We have not yet lived together." This is how I answered that question and had no issues. "None" is also an appropriate answer. "N/A" is not an appropriate answer because the question is applicable to you.
  • The Affidavit of Support forms and paperwork and the visa application forms and paperwork are submitted to the NVC. Submission of these materials will not take place until after the following two things have occurred: A) The NVC has received an approved I-130 petition from USCIS and B) the appropriate bills for the processing of the Affidavit of Support paperwork and the visa application have been paid.
