Risk withdraw K-1 for AOS, good lawyer needed.

Timeline

My finacee is canadian citizen currently visiting me from Canada.

my petition for I129F is on hold due to my namecheck problem.

She is pregnant. I was told that clearing my name in FBI namecheck may take years.

She is facing alone in vancouver during her last trimester if we continue waiting for K-1 approvel.

is it legal to get married in US and adjust of status while she is in the US?

one of the lawyer stated that canadian citizen do not need to show the admission date and time entered into us when applying for AOS, since Canadian citizen is not under VWP, but special arrangment between US and Canada.

But when I told him I filed K-1 and I would like to withdraw k-1 for AOS. He said no, your intend may have trouble and hang up on me.

She entered into us originally just for visit. Now if we wait long enough (about three months) then marry and file for AOS, what's the risk?

any one have good immigration lawyer, please recommend.

there are others here who had filed for K1 and then found themselves in the us and decieding to just get married.... and they now have there greencard.... is this the right way to do it ? who knows..... if you can with all truthfulness say that you did not have intent to remain when you entered then it is worth the risk...

You may want to talk to another immigration lawyer to go over your options....
