I-864 question (joint sponsor/co-sponsor)

Hi all,

first time posting here and I have a question about the I-864 form.

I'm not currently working (can't find any company that's willing to issue an H-1B visa) and my wife (who is a US citizen) is having difficulties trying to find work also. In order for me to be able to apply for a Green Card, one of our friends is considering being a joint (or a co-sponsor) or whatever you call it.

However, he is married with a wife and a kid (and another one on the way).

So my question is this. Assuming that me and my wife has zero income during the year, how much household income would he have to have to be able to sponsor us? Would it be for a household of four (for his family and me), a household of five (for his family and me and my wife), or others?

Obviously I would go to an attorney for an answer, but at the moment I simply can't afford one.

Thank you in advance for your help in answering this question.

It would be four (him, his wife, his kid, and you). If he has sponsored other immigrants and has a current I-864 obligation, he would also include them.

For a household of four, the 125% poverty line for 48 continental states is $28,812. http://www.uscis.gov/files/form/i-864p.pdf

If his second kid is born before you immigrate, then the household count will be five.
