OK this question is in regards to my fiance, he is getting the criminal background checks in the country he is currently in, and his home country. However he spent one year in Libya, before the 'arab spring' events started. When they spread to Libya, he left. My question is do you think it will be ok if this information is not included if we cant get it?

10/2011 - met online
06/2012 - met in person & engaged smile.png
08/2012 - Mailed I-129F
08/30/12 - NOA1
04/18/13 - NOA2

07/02/13 - Interview (Denied "not convinced" New Delhi)

Going to try again in his home country

Everybody will tell you, that it's better to tell the truth.

I remember when I filed my paper that I read somewhere (on one of the documents of USCIS) that for some counties Uscis does some exceptions (I don't remember the exact sentences that they use), but I'm 98% positive I read it on one of the form.

More likely when I was in my own country, so it was in the beginning of the process.

Read again the requirements and exclusions.

Good luck.

Honestly, I don't think so.

Criminal checks for the beneficiary are submitted at PKT3/PKT4 stage (depending on the country).

I believe the rules state that criminal checks are required from all countries the beneficiary lived in for longer than 6 months.

Check all the instructions when you get to that stage, but it might be worth looking into it now just in case.

The good news is it looks like you still have some time to find out, as you received NOA1 in August, it's likely you'll have a few more months to work it out.

Good Luck

My wife worked in Yemen for 3 years

But since Yemen will not issue a police clearance to a non-resident, the embassy did not require her to provide it.

Loooks like it is not available for non-residents, so you won;t need to submit one: http://travel.state.gov/visa/fees/fees_5455.html?cid=9671
