Sorry for the wait.. but it's a no for us... Yes.. my kingsley is highly upset. I can't get through to him bad connection.. but what he managed to say before breaking down on the phone. Was everything was fine then she kept going back to the file, and focusing on my sons father. She was trying to get him t believe that we are still together.. That the reason I never took the job in Qatar(how kingsley and I meet) Is because I must still be in love with my son's father. Even though, though I included a copy of my promotion and promotion pay in the file as to why I turned down the job. and even though My sons father is engaged and slated to be married in the spring.. I'm hurt the most because of all the things the could have flagged me for me being older, a short window to have more kids, or etc. The trumphed up some bullshit excuse... Sooo I'm not sure what to do know.. I have no problem marrying him now, but feel that it won't be the same..Like I'm doing it to prove to "them" we love each other.. Not sure if I can appeal, or write to congressman, or what.. Sooo goodluck to the next ones in line... By the way my school blocks face book so please feel free to post in the African married groups we are a part of..

But here's the thing, you just need to shift to plan B. Contact your Legislators in earnest and get the ball rolling. Do a search, I'll do one for you too, of a member who got his Fiance to be contacted for a secodn interview and recieved an approval aftger he contacted his/her Senator. This was for Lagos too. The Horses haven't left the ban yet.

oh forgot to mention that she kept asking who put this file together, it must be a lawyer involved. he kept saying no we did,, she said no way to detailed. Then when going through our pics. she kept asking why did you take this picture there, or why here.. It makes no sense.. #######!!!

Oh sorry for this sister...you know if the co assumption is that you may still be in love with ur ex then I guess they have not given him a complete denial, maybe they want more evidence to be sure...relax your nerve at the moment and then get full details of the interview and whether he was given a 221g request for additional evidence or something else...you've been such a strong person so gather more strength in this because it's your life... May God strengthen you in Jesus name amen!

SWEETIE! Ohhhh, my heart breaks for you. We having been waiting to hear. This is the second time this week they have had issues with the ex in Lagos. I hope you can take today to grieve and tomorrow will bring new clarification as to what to do. We are all still praying for you. Hugs.

Lagos at it's finest. You are through California with a K1 so the standard operation procedure is that is will be declared expired and you are free to file again which will not give you a chance to fight it. From what you posted they probably declared the photos staged and the relationship non bonefide, there may be more clues. I would go K1 again as you can strt the package today.

no the pics were asked about because we took them at the embassy in Aug.

My fiance wanted to go to find out exactly where is was and how long will it take and where to report and etc.. So we took a drive to the embassy my last visit and took pictures there.

Thanks I am trying to do that reasearch but have to teach lol should have stayed at home. The only thing that my fiancee kept saying was.. She kept asking why didn't I take the job in Qatar... Why did you too take the pictures here when you came to the Embassy, and are you sure she's not still with him... she grilled him for over and hour on these questions. Again I didn't take the job, because I was offered a better positon with pay.. and they have that letter in the file showing my pay increase!!! My sons father never even signed my sons birth certificate, we have never lived together... and he is 8 ..In fact I moved from Detroit to Az. and had him with out the Dad even present... Finally we took the pics. because I knew I wouldn't be there for the interview and He just wanted more evidence of us hanging out in Nigeria... I'm still floored!!!

I am so sorry to hear. First thing I would do is to make sure you were denied and not that they are requesting additional information. If you were denied, I wouldn't waste your time fighting it or trying to file another K1. Have your love come to your country and marry you there. Then file a cr-130. I know of several people that got denied a K1 and then filed a cr-130 and were approved. I also believe that the cr-130 has many advantages over the K1. Sorry K1 people, no offense!. Remember it is not how you start that matters, only how you finish. I was you good luck.!

So sorry to hear of the denial.

You need to contact your senator or congressman today and request a review by the chief consul for a second interview.

That is a slim chance but try it. Tell them you believe the CO acted in error and on assumption and forward your proof (ex,job issues)to him so he has something right away to get the chief consul to reconsider.

If they refuse and return your petition to USCIS it will take several month to get the data entered in the USCIS system.

You may not hear a thing for 4-6 month.

Get the diplomatic pouch number of the returned case from the senator so he and you can follow the case and it won't fall through the cracks or get "lost." Be proactive and call and email USCIS to show them you are still motivated to move forward.

They may not respond but every time you contact them it is entered into the system. Watch your USCIC status online for any changes.

CSC will let returned K1 petitions expire but every once in a blue moon reaffirm them. I am currently waiting for my blue moon to rise as I am unable to travel to marry and refile right now anyway. CSC usually sends out a letter stating " Your petition has expired you are free to refile again."

VSC usually reaffirms them with a cautiously estimated time line of 4 months or so.

In a few cases no NOID/NOIR was send, no rebutal needed but the case went straight back to the embassy without giving any notice to the petitioner. This is not the norm.

If you marry and refile it will sometimes but not always kick in a NOID/NOIR letter to which you must respond irregardless of your refiling.

It will be a long haul from here and the next 6 + months will be difficult. Appeals are extremely lengthy and very costly and not worth it. Either push proactively for reaffirmation with the help of a senator and see what happens or marry and refile.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
