Can I file emergency AP without filing AOS

I came here on a k1 visa and got married on Aug 7. I was 34 weeks pregnant when i got here in hawaii and just delivered a healthy baby girl on aug 17..

Yesterday, I found out that my dad is suffering from diabetes, the doctor told my family that his legs are infected and need to amputate..

It was very hard for me and i keep on crying everytime i think about my dad.. I wanted to go visit him and give him hugs kisses love and support.. I also want him to see his first grand child..

I would like to ask if emergency AP is possible..if yes, how can i apply it. and how long will it take.. or are there any requirements or etc..

We havent filed for AOS because we dont have budget now to apply. also im still healing from my delivery and been busy taking care of my baby.. but i really want to see my dad..

I am sorry for your situation.

Without filing for AoS you cannot file for or receive AP.

Unfortunately you can't apply for AP without filing for AOS.

You can leave without filing AOS but you'll have to file, and wait for, a CR-1 visa before you can come back. Not to mention a passport for your child.

I am sorry for all your stres but above poster is correct, you must file AOS to get AP.

The only other alternative is to leave, then have your husband file for a CR-1 spousal visa and wait it out in the Phils for 10+ months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No AOS, no AP sorry.

They're right, if you've decided to leave US you'll have to re-apply for CR1 and start all over again.
