Hi, I'm a Canadian on TN marrying an US citizen.

I'm reading that for TN status individuals once we have intent to marry, we should apply for green card/change of status as soon as possible. We can get married down at city hall in the next few weeks but we don't yet live together (we're both in the same city it's just he has 2 cats and I'm allergic so we haven't co-habitated sooner). We have started looking for an apt together but it may take up to 2-4 months.

Should we wait for us to have the same physical apartment address before sending in the AOS, thereby fulfilling the evidence of marriage requirement? We have lots of other family/friend affidavit of support, travel, communication to show this is a real relationship, but just wondering whether not having same address while living in same city is a red flag?

Any advice would be most appreciated. Thank you!

it may be a red flag, but you could always bring up the 2 cats, your allergy, and the fact that you two have been looking for an apt together, though ..... I'm not sure. Wouldn't he bring his 2 cats to the new apartment too?

I'm just wondering if it'd be acceptable to send package in before we actually have an apt together and use other evidence of support instead. But if it's a red flag, we'll wait.

We may have to bring the cats after all. He's considering giving them up because of my allergies but they're two adult cats w/chronic medical issues so not candidates for easy new home adoption :-(.

in general, the documents they like to see are joint homeowner or joint lease, joint insurance documents, joint bank accounts, spouse listed as beneficiary on 401ks and life insurance, joint car titles, joint tax returns or tax returns with the same address etc.

Just the personal stuff alone won't guarantee approval. They want to see a mingling of assets. If you don't have a lease together, it's not necessarily a red flag, but that will definitely depend on the rest of the evidence that you have.
