Hello all,

we just filled i-130 with i-485 with 131 and sent it with wrong payment amount , its returned to me all the package,, i read online its gambling if u want to travel while ur 485 is pending so i have to travel after two months and maybe at that time my travel paper not came yet, so its dangerous to go out while its pending. after we received the full package returned now, we said its better to apply for CR1 and make the interview in Saudi Arabia where our marriage took a place, i have couple questions:

1-is this more safe to do this?

2-i have B visa Valid to 2013/Jun...CAN i reEnter USA by B visa to visit my wife because she will be alone studying while CR! pending?

3-so when we apply for petition i-130 to get CR1 ARE we going to include with it i864 for sponsor and joint sponsor and medical examination sealed form? its all ready so can i attach it to speed the process?

maybe u gonna ask why u just adjust the status and u gonna be fine, my answer i don't have time to adjust status i have go back home in saudi arabia urgent.

The I-864 is submitted to the NVC and that will not be happening until they receive an approved petition from USCIS and the applicable bill has been paid.

You can visit while the the petition is pending, however, there is no guarantee that you will be granted admission to the US by CBP.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

how i will submit 864 to NVC? make it ready to mail from USA or e-mail it from aboard?

my wife USC will be in usa for study i will return back to work and maybe come for visit till CR1 approved.

You as the beneficiary will not submit the I-864 to the NVC; the US Citizen petitioner submits that paperwork.
