Being one of the few couples who were actually approved using a cosponsor for K1-Visa (Approved on Sept10 ,2012). Perhaps I can provide some encouraging feedback for you. As far as our process, I made sure to documented any important phonecalls. I actually called up USCIS and explained to them about my situation for needing a cosponsor. USCIS actually recommended for us to use I-864 w/I-864A(s) instead of I-134. We ended up filling out I-134 for the interview just to be safe(best to have it and not need it,than to need it and not have it;), but we actually never turned it in. They asked for I-134 during the pre-screen, but then we ended up turning in I-864w/I-864A(s). We told them at the USEM that I spoke to XX Person at USCIS Customer Support,on XX Date at XX Time, which after speaking to the supervisor they allowed us to turn in the I-864w/I-864A(s).

As far as the public charge concern, they seem to look more into your future earning potential than your current situation. They were pretty extensive in asking my fiancee about her work experience(she's a RN in PI for several years). I remember them asking her if she actually worked in her field of study or pursued work options in a different field. Getting yourself setup to be able to find employment prior to your interview may be a good option i.e NCLEX and board certified in whichever state you plan to reside/work in.

If your mom makes over the 125% Poverty Guidelines I don't see how there would be many issues on the monetary end. Will you be living with your mom? I guess I'm a little confused over the living arrangements. I ask since if you plan to use I-864 w/I-864A you must be living at the same address as your co/joint-sponsor to use I-864A. Otherwise you may have to use other options using a cosponsor, which perhaps someone else here on VJ can provide some advice.

Hey thanks for replying!

I was just wondering how did your interview go? Cuz i read somewhere online that the consul asked if the fiance could financially support you during your stay in the US... and assuming that your husband was a Med student, he didn't have a job then? Did they ask you that question? and if they did how did you respond?

Thanks a lot!

God Bless!

I didn't get that question during my interview. The Filipina consul just asked me what my fiance's job is (tech support) and what he finished (medical school). During medical school here in the Philippines he had 0 earnings and was dependent on his parents. I guess had she asked me if my fiance could financially support me, I would say "Yes, ONCE he becomes a resident physician." Obviously she already knows that my fiance is unable to earn 125% above the poverty limit because she would've seen my co-sponsor's I-134. Sometimes, the way you answer has to be "safe" yet honest. But it's possible not all consuls would have taken that for an answer especially if they meant "as soon as I get there". The answer to that would be "Not yet but his dad offered to co-sponsor us in the meantime while we apply as resident physicians". Very case-to-case as you've probably heard others describe their dreaded interview on co-sponsorship.

There are no hard and fast rules for picking co-sponsors but I would like to hope that a family member who earns 125% (or more) above the poverty limit for all the household members (including the one being petitioned) is enough for them to approve you. Plus you both have promising careers ahead.

But as I've said, look into the marriage visa processes because that might be more apt for you =)Good luck dear!
