I got my Certificate of finality and annotated MC from NSO done last july 2012.. Our application accepted April 23. So sad to think that our application might be subject to a denial.. after all the waiting :(

I'm sorry but court decision documents only doesn't make it legal for you to marry another as of yet. If you should have waited a bit more then, maybe there's a chance.

Your petition will be denied. You were not free to marry at the time you sent in the I-129F, and that is a requirement. You could withdraw the petition now and file a new one now instead of waiting for the denial before starting again.

Court decision declared my previous marriage as null and void and signed by presiding judge. We thought it was fine and bring all other required documents to the interview.. Thanks to all who responded to my question with helpful info. My fiancee and i decided to just wait until next week since its almost 6 months and see if we get RFE for certification of finality or get denied, its not that long to know about it anyway... :) Good news/Bad news my fiancee will go to our attorney and we look at options.. We never found it easy to be in a long-distance relationship...but when we've found each other and we wanted to spend the rest of our life with (L) (L) (L) never felt that we had any choice except to find a way to be together, and stay together. :) :) :)

And you will be together, that's not the issue, the only unfortunate part is that it may take a little bit longer than anticipated. You will get there though! Just out of curiosity, did you say that you had a lawyer helping you with the petition? If so, he/she should have known this.

Yes we had attorney but she didn't say anything about it.. :unsure:

We hope that they accept your documents without and any RFEs or denial. It would be a shame if they do/don't give you a RFE and then decide to deny you at the interview. We wish you best of luck and you two are able to be together as you have planned. :thumbs:

I don't think that any of us are finding it easy to be in a long distance especially those of us in an across the ocean relationship. It is great you want to find a way to be together and stay together but you got to do it step by step. If you filed before your annulment was completed your petition will probably be denied :(

Hello Everybody! I just wanna ask if there's someone here who got a RFE from VSC for NSO annotated MC? I was annuled, i only included my court decision on our petition just to save some months waiting while processing the other annulment papers that i need. Our application accepted April 23. I got my Certificate of finality and annotated MC from NSO.. Just wondering is that the final paper that USCIS need? :help: I kinda worried that i will get RFE for that. :unsure:

i think u will do fine... read from someone that he sent only the court decision tho its risky like u said u might get an RFE by doin that but they were approve without an RFE as far as i know... :)

I'm sorry to hear about your bad news. It seems your impatience led you to make a bad decision. You will have to apply again. Best wishes for your next application. :thumbs:

They had an attorney. It was his/her bad decision. They paid money and trusted someone who supposedly "knows the law". It was not their impatience but their lawyers fault for misleading them. :bonk:

Update: We got approved on our interview Jan.28,2013. The date when the judge made decision is the effective date for the process not the date when the certificate of finality and NSO annotated certificate of marriage are completed. Thank you all and God Bless. :)
