Hello Everybody! I just wanna ask if there's someone here who got a RFE from VSC for NSO annotated MC? I was annuled, i only included my court decision on our petition just to save some months waiting while processing the other annulment papers that i need. Our application accepted April 23. I got my Certificate of finality and annotated MC from NSO.. Just wondering is that the final paper that USCIS need? :help: I kinda worried that i will get RFE for that. :unsure:

We just got our Petition approved and we sent

1) Court Decision (signed by judge)

2) Certificate of finality

and

3) annotated MC from NSO

and got no RFE's.

Keep in mind that hopefully the date of Certificate of finality is dated before the date of the petition. There have been some cases where people have run into problems because they were not free to marry because their Certificate of finality was issued after they filed the petition.

Example my loved one's decision was issued Oct 10th,2011 but her Certificate of Finality was issued Jan 29th,2012 so we filed in Feb. Because the court decision is just that a court decision. The annulment is not final until the Certificate of Finality is issued.

Do you have any idea why your approval for NOA2 was longer than the average? :blink: Was it because of the previous marriage and the annulment situation? Do you know of a situation where someone from the philippines was denied because their certificate of finality was after the NOA1 date? Hope to hear from you soon.. :)

If you are talking about the divorce, then the rule applies to everyone, regardless of the country. You HAVE to be free to marry at the time you submit your application. So if the certificate is issued after NO1, my understanding is that this will be a reason for denial.

Sounds logical, do not apply till you have the proper documents.

i only included my court decision on our petition just to save some months waiting while processing the other annulment papers that i need. We supposed to get our NOA2 nextweek, so sad.. :(

Yes, Finality or Entry of Judgment states marriage is Void ab Initio (will be last docs you'll get from the court). They'll also annoted your original Marriage Certificate with Null and Void. Then you'll take to the Local Civil Registry to get the Certified Copy. It doesn't end there, you'll need to take those docs to NSO where they transfer the Marriage Certificate to a special paper. These will take up to a month or more to process. If you haven't done all that or if you've hired an Atty to do it for you then techically you're not free to marry and you're not eligible to file I-129F

Good luck, USCIS and NVC might overlooked it but USEM will catch up (I've seen it happened to a couple of members here recently) and will give you automatic denial even after you've paid your visa and medical fees.

Their file is still at USCIS stage. They have not received NOA 2 yet, thus they might be subject to a denial.

sorry to know this and yes,subject for denial if the USEM found out, youre NOT free to marry from the time your fiancee sent the application(129F)just pray for good...

Thank you so much. I appreciate it.. Makes me cry :crying: we have to re-file the petition all over again.. :crying: seems like endless :(
