hello every one

my wife applied for the my i-130 last september , then applied for k3 , they sent her the froms back ,telling that we should file for it from egypt - the country we married in - i checked the embassay no confirmation about that , my wife and my step daughter have sever heart problems , cant move to live with me in egypt and travelling is not good for her , so my questions are :

1- can i apply for k3 visa in usa embassay in cairo by myself or my wife must be with me ?

2- we have proofs of my wife medical conditions as critical ,how this help in both k3 visa and i-130 ?

3- does it make difference as my wife has sever medical condition in making the procedures of k3 go faster ?

4- i read that u dont pay the fees of k3 f u paid for i-130 ,is that true ?

5- has any one applied from egypt for k3 can reply me ?

Where are you in the process? Have you passed NVC yet? I would be very surprised if your K3 wasn't closed at NVC, it is an obsolete visa.

1. Your wife petitions , then you go for the visa interview. She does not need to be with you.

2. Your wife can send doctors letters and ask for an expedite, but she needs to show why YOU need to be there (as opposed to a friend or family member helping).

3. See 2 - the K3 is no faster than the CR-1 these days, that was years ago that it was faster.

4. You need to pay more for the K3 once you get to the USA, and won't be able to work for several months. It is unlikely you will be able to get a K3 anyways.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

my wife got the forms back when she filed me the k3 in the states ,told her that i need to file from egypt as we gotmarried here in egypt .

why its unlikely to get the k3 visa ?

Because when the I-130 and the I-129F arrive at NVC at the same time, which they usually do, NVC will administratively close the I-129F/ K3 path and force you onto the CR-1 path. If by fluke it gets through, and you get the K3 visa (chance of 0.01% going by VJ experience), it is a worse visa than the CR-1, because it is no faster and you need to spend more money, time, and paperwork for Adjustment of Status in the USA

I applied for the K-1. K-3 is obsolete. There's no K-3 or DCF in Egypt. The only options are CR-1 or IR-1. Read Penguin's answer.

thx ayman for ue reply , yes its very frustrating being away from my wife like this ,and we cant risk her health of traveling and moving here , how long it took u to get ur cr1 visa ? if i may ask , was it complicated coz of egypt situation or it went smooth ?

does my wife have to send the papers of her medical condition to the embassay in cairo or to USCIS in the states ?

but does it mean that CR1 visa is the normal way every one goes for after they get i-130 approved ?

yep, everyone goes the CR-1 way.

In terms of expediting, you need to do this at every stage- ie you send the expedite request to USCIS first, then to NVC, then the mebassy. An expedite, even if approved, does NOT carry through to the next stage.

We are at NVC stage if you look at our timeline you can see where we are at..NVC received my i184 yesterday so we go from here and see what will happen :( good luck to you :thumbs:
