Hello VJ,

My wife and I were not able to file the adjustment of status for about 2 months AFTER the K-1 expired. The USCIS acted like it was no problem and to get it filed as soon as we could. Now it's been 3 months since we filed and had the biometrics etc. Should we be worried?

No, you are fine. Lots of people wait because they don't have the money or for other reasons. The K-1 expired upon entry to the USA. As long as you married within the 90 days, it is okay. I believe the average time for a response for AOS from them is 6 months. A friend of mine filed last December and has still not been approved--no RFE or anything. Once the 6 month mark has passed, I believe you can call USCIS to ask for a service request to find out what is happening. Good luck!

My wife and I didn't file for AOS until 6 months after the 90 days. During our AOS interview we were never asked why we didn't file before or why did we filed after.
