Hello all, Just a quick question about the K-1. I filed for a K-1 visa as we are engaged, However we were planning that after we got our visa and were ready to bring Her to the states, That we are going to have a wedding over in the Philippines for her family and friends, then have a seperate one in the US, for my family. The question came up, if we get leagally married in the Philippines, then try to bring her here on a K-1 Visa instead of the Spouce visa. Will we have any problems?

Thank you all in advance!

-Steve

If you marry in Philippines before coming to the US, she will no longer be able to come into the US with a K1 visa. That constitutes visa fraud, as you'll be married already.

You will have to start ALL OVER again, and file a petition for a Spousal Visa.

You must be unmarried to use a fiance visa. If you try to use the K-1 after marriage, she will be deported and banned from the US for visa fraud. Yes, it has happened.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You can have a ceremony and a party for the family BUT, do not file anything. Just have a celebration, like an engagement party, that's what we did.

Don't do anything to screw up your K-1.

Stay away from the church. Just have a big celebration party at home. It'll be fun, and the family will enjoy it.

That's what we did, but I've been tempted to get married in the PHils for fear of taking so long. We had our engagement party, catered by a close friend, and had so many happy friends and family to celebrate with. I hope that it was our engagement, and not just all the Red Horse and San Miguel Lite, that made the partygoers merry! Heh heh!
