My wife is here as permanent resident. I am confused on how to file taxes and apply for financial aid because our marriage certificate is overseas.

How did you guys approach this situation?

Do my wife file single on taxes and financial aid?

01/20/12 - I-130 sent to Chicago Lockbox.

01/26/12 - NOA1 received and processing at Vermont.

06/28/12 - NOA2 announced on status check.

06/29/12 - NVC received case learned on 07/2/12.

06/30/12 - Hard copy NOA2 received.

07/09/12 - NVC Casefile Number and IIN Issued.

07/16/12 - Receive and Sent DS-3032 via email.

07/17/12 - Mailed DS-3032 via mail, AOS bill received via email, paid online, Optin email sent.

07/18/12 - Optin accepted and new case number, AOS marked paid, emailed AOS packet.

07/24/12 - Assigned as Agent, IV Fee bill received via email, paid online.

07/25/12 - IV Fee marked paid, emailed IV packet.

07/31/12 - Emailed GZO Supplemental Packet 3.

08/02/12 - Case completed and commenced final review.

08/03/12 - Shipped all copies of forms/letters/documents to my wife - arriving on 8/9/12.

08/06/12 - Case completed final review.

08/09/12 - Appointment letter received via email interview date set 9/6/12.

08/14/12 - Medical exam done.

08/15/12 - Medical exam results all normal.

09/06/12 - Submitted required documents at the embassy and interview set next day at 0730.

It doesn't matter that your marriage certificate is overseas. You're still married. You can poll your income and deductions and file jointly, or you can choose 'married filing separately'.

Do my wife file single on taxes and financial aid? NO. NO. NO.

Your wife does not need your marriage certificate to file taxes or apply for financial aid. The marriage certificate does not matter for these two purposes.

Your wife is married. Do not file her taxes as single. Do not ever say that she is single.

Your wife will need to remove the condition on her green card in 2 years by proving a bona fide marriage to you. It does not help and it actually will hurt you if you bring in tax returns where she signs under penalty of perjury that she is single. Not going to help.

Your wife files her taxes as married. She applies for financial aid as married. She is married. She is not single, so don't ever list her as single.

wow. things got complicated here.

i am married overseas in november 2011, she didnt get here till october 2012. i insisted that my accountant add her to my 2011 taxes but she never did. should i get my accountant to amend the taxes?

i am married overseas in november 2011, she didnt get here till october 2012. i insisted that my accountant add her to my 2011 taxes but she never did. should i get my accountant to amend the taxes?

I hope you filed your 2011 tax return as married filing separately, and did not list yourself as single. On Dec, 31, 2011, you were a married man, so you cannot file your 2011 tax return as single.

Your accountant could have obtained a Individual Taxpayer Identification Number (ITIN) for your wife to allow the two of you to file "married filing jointly" instead of you filing alone as "married filing separately." Your wife would elect to be treated as a US taxpayer for 2011. Her foreign income would need to be declared on your joint 2011 tax return.

After your wife gets her Social Security Number (SSN), the two of you can go back to your accountant to amend your tax return to "married filing jointly." (She does not need the ITIN if she has a SSN.)

If your wife's income was low, you may even get a refund by amending your return.

so,

when yer wife gets a SSN,

file an amended return, a 1040X, for tax year 2011.

As for financial aid, hit fafsa.gov and start the application process.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

i suggest at least registering for fafsa.gov NOW then,

as ultimately the tax return will be reviewed again by a financial aid officer at the school,

and the fafsa score will be recomputed on the fly by that said human.
