My wife's conditional green card expires on 21-FEB-2013. I will file for removal of condition exactly on the day we are eligible to file. From what I've seen, conditions are not removed within the 90 days left before green card expires. If the condition isn't removed before green card expires, what then? Does my wife have have to leave USA?

We will file 1751 on 23-NOV-2012. We're planning on going on a vacation on 20-DEC-2012 (to 15-JAN-2013). Do you think, she will be asked to do her bio-metrics before 20-DEC-2012? If they schedule is when we're away, can we reschedule it?

she will receive her NOA1 or notice of action, this notice has an extension for 1 year for her conditional GC. if her GC expires, she must travel with the letter extending her GC for 1 year and her expired GC

she cannot travel without the letter, she can work and travel with the letter of extension

First and foremost, take out of your mind if wife have to leave USA as you/her have complied with all requirements until now and will continue complying with the balance.

As you already know and have already planned, conditional expires and you must file within 90 days prior expiration. What will happen is, her card will expire as the processing time will take a reasonable long time [9 month at least]. However, she will received an extension [1 year] and she can travel in and out of the country and pass back into USA as long as she has her extension letter.

Biomatrics are unpredictable as we cannot schedule them in advance, however in many cases, you can do a walk in and get them out of the way earlier as long as you have received your appointment letter.

You batmen and batwomen are as awesome as I remember you to be from few years ago. Now I feel guilty for abandoning you. It's like I used you when I needed you and I left you when I didn't. Now I'm back again when I need you. Right here is a selfish person. :(

I just used some of your data and made a projection. See below. If projection holds true, my wife will be scheduled to do her biometrics on 28-DEC-2012. But her and I will be in Bangladesh during this time. So we probably won't be able to make it on this day. Provided we cannot go in early and get it done, can we call USCIS or biometrics office and reschedule? I hope so.

One more question: Do I have to file exactly on the day from which 90 days is left for her GC expiration? Can I file exactly 60 days before her GC expires? That's within 90 days.

In that case, rather than worrying about if I can reschedule bio-metrics interview date, I will just file the I751 a few days before going to vacation. Then, there would be no chance of being scheduled while we are away.

You can try and do a walk-in biometrics appointment, once you get your NOA1 and Biometrics appointment letter. I don't know if all centers offer them though. Personally I would file as soon as the window opened and let the process start. Then as your vacation gets closer, try giving the USCIS a call, just in case you receive any correspondence regarding your application, check etc... (which we've seen posted on the forums just last week) not just the biometrics.

11th October 2012: APPROVED!

24th February 2012: Biometrics appointment

8th February 2012: Touch

24th January 2012: Biometrics NOA date (received 30th)

19th January 2012: Check cashed by VSC

17th January 2012: NOA date (received 20th)

14th January 2012: ROC delivered via USPS to VSC

13th January 2012: Filed for ROC

Earliest date to remove conditions: Friday, December 2, 2011

9th March 2010: GC in hand

1st March 2010: Interview 8.40am APPROVED!

1st March 2010: EAD arrives, along with daughters US passport

15th January 2010: Biometrics appointment

10th December 2009: Filed for AOS

It looks like "based on history of ROC filling", if you file on Nov 23 2012.

You will get NOA1 by end of NOV 2012 or first week of Dec 2012.

And, you will get the bio-metrics appt around End of Dec 2012 or early Jan 2013 (you will be out of country at that time).

You can schedule your appt by requesting it OR you can do an early appt by walking-in.

Even though, you can re-schedule your bio-metrics appt. But it is not recommended to add extra step (as always you can do early walk-in)

It depends on number of variables and you don't control those variables... (NOA1 on time, appt letter on time)

I know one of my buddy reschedule her wife bio-metrics appt for ROC, it took extra 7 weeks before she was scheduled.

You can file any time during that 90 day window. If you will be out of the country for part of it, then prepare everything before you go, and file the forms when you return. You can reschedule the biometrics if necessary, but you don't want to miss receiving the appointment letter by being out of the country, so if you have time to wait, then wait and do it when you return.

Thanks for all the awesome replied.

My wife and family is now worried about this. Is there any reason she wouldn't be allowed back in USA? I mean her green card doesn't expire until 21-FEB-2013. And she will be back in America on 23-JAN-2013. She will have a month to spare before her GC expires. We wouldn't have risked it unless we had to go to go to Bangladesh. Be have to. Kind of feel like being stuck between a rock and a hard place.

Have anyone gone out of country while on their first 2 years of CR1 green card? Did you experience anything that was different when you came back to USA?

Not to be rude, but her card is not expired at the time she enters, so why would she have problems? it's not expired, she's still an LPR, she's permitted entry. It's really that simple. She MIGHT get pulled into secondary (but that happens to people who have applied for ROC, some even before the ROC window is open, or right after getting the first card), she MIGHT have someone make a comment like "this expires soon" but they won't deny her entry.

You said you're going to file the ROC before you leave, so it will be on their system. Don't stress about it.
