Question about evidence for K-1 petition

Hello!

I am sending my petition soon and I just want to make sure that I am doing everything correctly. For my evidence I have, copies of passport stamps(from both mine and my fiances passports), boarding passes, itineraries, copies of bank account transactions made in my fiance's country, and about 15 pictures of us together. I am here now in Hungary with my fiance and we are going to send our petition to my mother in the U.S. and she is going to send it to the Dallas Lockbox facility. I was wondering if it for some reason would be bad that I am here in Hungary (The US citizen petitioner) now and my passport stamps show that I have entered Hungary in September and am still here? Do I have to be present in the US when the petition is sent? I would think that it is more proof of an ongoing relationship that we are here together at the moment. Does anyone think that this could cause of any problems? The question is not regarding overstaying in Hungary because I am not, I am just wondering if it is allowed to be in the beneficiary's country when the petition is sent.

Hello!

The evidence that you need to present when filing the petition is not to prove an ongoing relationship, but rather that you have met in person, at least once, in within the past 2 years.

So, on question 18 of the I-129f, you should have explained how you two met, correct? Something like: We met in Hungary when I visited her in <insert date>.

The evidence you'll send, is to prove that you have, in fact, met her in Hungary in <insert date>.... makes sense?

If you are going to send copies of the pages with the passport stamps, from both of your passports, I suggest you copy ALL pages of each passport. Because they'll have to match the stamp to the person, and a simple copy of a page with stamps will not be enough. Save youself time and possible RFEs and copy the entire passports, front to back.

All other evidence you described, seems to be OK good.gif

The fact that you are in Hungary, at this moment, is not an issue, at all. You do not have to be in the US to mail in a petition.

After you send the petition, keep documenting your visit, and you she'll be able to present that newer evidence at the time of the interview to prove ongoing relationship (along with other things, of course).

I have included a " Form I-129F Supplement: Part B, Question 18, explanation of meeting in person" in my package.

When I am making copies of the passports should I do like one page of the passport on one page of paper? That seems like ALOT of paper, haha.

Is the evidence that I have enough? I am so worried about getting an RFE! Are boarding passes, passport copies, pictures, and flight itineraries really enough? If I did include chat logs would they really want to see that? Just like random conversations? I have even thought about print screens of both of our Facebook pages(Our profile pictures/cover pictures are of us), I have no idea if that's a stupid idea or not. I could make print screens of text messages from my iPhone. How much evidence do I really need?

I think you have enough evidence. Include a couple of photos of the two of you together and print the time and place on the back. I wouldn't bother with the skype logs- keep it nice and simple... Good luck!

In RE to the passport copies, make them so you can see them very well; but it doesn't have to be one page per page.

In RE to the evidence, as I said before, it sounds like you have plenty; but the best way to "know" if you have enough is by doing the following:

- Pretend work for USCIS and you receive your file to work on it.

- You need to establish that: a) A US citizen wants to marry a foreigner b) Both parties are free to marry c) Both parties have met, face to face, sharing the same time and space, at least once within the past two years.

Will the evidence you have at hand, prove these 3 items?

a) You will establish US citizenship by presenting copies of all pages of your passport [Check]

b) I assumed you were both single (never married). If either one of you have been married before, you will have to present copies of the final divorce decrees from your previous spouses. If ANY of the divorce decrees is in another language other than English, you will have to submit a translation of it.

c) Passport stamps, boarding passes (not itineraries because, for all they know, you could have skipped getting on that plane), hotel receipts, ATM transactions and pictures. Chats, Skype, IPhone screenshots will only prove that you communicate with one another, but it won't prove that you have met face to face and THAT'S what you are trying to prove.

So, now that you pretended to work for USCIS and reviewed your own file, would you say you complied with the requirements? Would you approve the petition in front of you? or would you need more proof that a+b+c have been proven with evidentiary support?

For passport pages, what I did was copied several pages to fit on one piece of paper, so all pages of my passport fit on 3 pages. I printed all pages of my passport to prove my citizenship, but then for my evidence of meeting I only printed the pages with the passport stamps and my bio page. So you should be OK with just printing your bio page and the pages that have your passport stamps.

I only included a little evidence of our ongoing relationship, but I didn't include much at all. We are presenting our evidence of relationship, if its asked for, at our interview next month.

By copying all pages of your passport, you'll be killing 2 birds with one stone.

It'll, most likely, be sent to California.

When you receive NOA 1, there will be a Receipt Number assigned and it will start with EAC or WAC. I

EAC = Vermont Service Center

WAC= California Service Center

Once you get that information. You can complete your Timeline and get an estimated date of approval for your petition.

Ohhh too much for my taste. They don't want neither your love story nor every single encounter you had. You simply have to answer the question at hand. The size of the space to add that reply, should give you a clue of what they want there (no need to even add a supplement sheet).

Yours should look something like this: "We met while Adam was vacationing in Houston, TX on June 5th, 2011. Since then, we have spent as much time together as possible. I'm currently visiting him in Budapest."

That should be your answer for question 18. REMEMBER that all you need to establish is that you've met, not how many times you've seen each other after the first time (at least not for Hungary... maybe for high fraud Countries, but not you!)
