Can My fiance' file for the Green Card lottery?

Hi everyone,

My boyfriend and I are still waiting to be able to file for our K1 (i found out recently that my divorce never got filed!! So i am now waiting for the final decree to be mailed to me)

He is planning on entering the lotterly again but we are thinking that if he does and we file for our K1, somehow he will be automatically rejected for either one as it will look like the marriage will be a sham and he is too desprate to come to america. He is Australian living in the UK. We have been waiting for this to all happen for months! Please give us some direction as we dont want this to be messed up permanently and we will never be able to get married! Its our worst fear.

Not sure of the risks, if any, for running simultaneous visa petitions, to include the lottery. I guess I don't need to advise you of the remote possibility of actually winning.

Personally, I would focus on the "nearly sure thing" in the K-1 petition, rather than the lottery. However, this is a personal choice.

While I am no expert either but I would think they are two indepenant transactions and one has no influence on the other and if you were successful in the lottery then you could simply abandon the k-1.
