Advice needed about my situation.

I'm starting to get very confused with all this visa stuff. The part where I am at now, is pretty simple (The i130)I have completed that and I will be filing with DFC in London as soon as I sort out the minor (expensive) headache I have, but its what comes after that, I am a little confused by. I have mentioned in a topic yesterday, that I am using an agency that has not been very helpful at explaining things to me and has left me with a lot of unanswered questions as they dance around subjects and get me completely mind boggled..

Let me first explain my situation, and if anyone could give me some sort of input and advice on what I should be or should not be doing, please feel free.

I married my British husband in March of 2011, and moved to the UK in May of 2011. He and I want to move to the States, because we were both much happier while we were there than we have been while we were here. (he took a 3 month sabbatical from his job in the UK and stayed with me under the Visa Waiver Program from Feb to May of 2011 and we really enjoyed our life together there)

Now, since I have been staying in the UK for so long (1 year and 6 months), I do not have a job back home, but will be no problem for me to get one.

My husband has a promised Job upon his arrival in the States and can start work as soon as he is legally able.

I do not have the financial means to sign the affidavit of support and will not until I start working again.

On that note though, my Aunt and Uncle whom have no dependents under the age of 18 that they are financially responsible for, are willing to be sole sponsors for my husband and my family (if that is even needed). Combined they earn over 50k a year (Not giving exact amount) but lets just say they are adequate.

I will have a house when I get there, but the problem with the house that I am going to have is that it is "Income based" I'm not sure if this will be a problem or not, and if it is, the I can surely find residence somewhere else.

My Aunt and Uncle have already said that we could stay with them in their home until we are able to find our own place which would not take any longer than a month.

Does it seem as if this set up would work? Any tips on what to do next or just any general advice on my situation at all? I am filing DFC because I've read it will be a much quicker process.

One thing that comes to mind in your situation that some don't know. You will have to submit your latest tax return with the I -864 Affidavit of Support. Even if you live in the UK, you are required to file a US tax return in most cases so look into that and make sure you have a current tax return.

You will file I-864 regardless of having a current US job or not. Your relative can be a joint sponsor. All that will be taken to the interview. You are supposed to show you have or intend to domicile in the US because sponsors must live in the US. So think of ways you will do that. Do you still have a valid US drivers license or current voter registration? Or before your interview, get a lease signed to show your intent to move or get the relatives to write up a statement that you will live at their address. It's not as difficult as it sounds...just something to plan ahead for while you spend a few months waiting on an interview. You have already talked about having a place to live so just document it in some way prior to the interview.

Those are a couple of the things I see people forget to do. The rest is pretty easy.

1) Fill in I-130 form. http://www.uscis.gov/files/form/i-130.pdf and do the other forms listed here http://photos.state.gov/libraries/un...for_spouse.pdf and stick to the exact format they tell you to. This costs $420.

2) You will get an email (usually, some people dont) to give you the notice of acceptance often referred to as NOA1 when they have received and filed your I-130 package.

3) Wait until your date comes up here http://london.usembassy.gov/dhs/uscis/i130filing.html When it does, you will be receiving in the mail your NOA2 (notice of approval) or an RFE (request for further evidence) which you have to respond to and give them anything that they request.

4) Fill out an affidavit of support (I-864). You will probably need to use a use a joint sponsor who will also fill out an I-864. With that, you need US tax returns and W-2's and a photocopy of the joint sponsors birth certificate or passport. You should have been filing US taxes even when you were away, so if you havent been, you needs to backfile for the 3 most recent tax years. You can prepare all of this while you are waiting for NOA2.

5) After NOA2, anywhere from 1-4 weeks later, you will receive a LND case number. When you have this, you can book a medical with Knightsbridge Doctors. That costs £227. Your vaccinations should be up to date before you go. You should only need to have had 2 MMR's and a Td / TdaP (the tetanus one). They can be done there, but they are around £30 each so it is easier to get it done before you go with your normal doctor, usually for free. If you have your medical between 1st October and 1st March, you also need to have the flu shot.

6) You then send off (you can do this as soon as you have the LND number) DS-230 part 1 (This is the actual visa application.Take part 2 to the interview) and DS-2001 (notice of readiness. Only send this if you have everything you need to be interviewed).

7) Wait for an interview date and get there when they tell you to. Visa should arrive by courier anywhere from 2 days to 2 weeks later. You will pay $230 for the visa at your interview.

Total cost: $650 and £227.

For the proof of intent to establish domicile, you can show job offers, resignations from the UK, lease on a house etc.

I haven't filed taxes, simply because I have not had a job since my 5 year old daughter was born. So with in the last 5 years, I have not worked, what w2's and tax forms am I supposed to provide if I do not have those?

When I met my husband I was a single mother (due to the death of my previous partner) and I was a student, I didn't have a job, and I never needed to file a tax return. I'm getting confused again ):

If you didnt file because you were not required to, simply type up and sign a letter explaining why you werent required to and attach it to your I-864.
