Questions about CR1 or K1, Peruvian with a child

Hi,

I am a Peruvian single mom of a young child, and I am engaged to an American man. We are looking into going with the K1 or CR1. We want to know how long the whole process will take, and whether it takes longer if you have children involved. Also, would we need to file for the child on a separate petition?

Anticipate 5-7 months from the time a petition is filed to the time an interview takes place for the K1 process and 7-10 months from the time a petition is filed to the time an interview takes place for the CR-1 process. Having children involved makes no difference in either timeframe.

If you follow the K1 process, only one petition is needed, the child is eligible for the derivative K2 visa. If you follow the CR-1 process, two petitions (along with the applicable fees) will need to be filed.

Besides what's been answered, you both might want to give some consideration to the following:

CR-1 results in a GC upon arrival to the country, K-1 will require AOS (adjustment of status after marriage) which is going into 6 months, thus a "longer" process overall.

Let's not forget that AOS will also have a cost, that overall could result in a more expensive route.

A K-1 can go 9+ months end to end, that is, from the initial application, to visa approval to visa number allocated to the process at the embassy. On a K-1, there are multiple agencies and processes, each one with its own delays. CR-1 might end being shorter, but not by much. As you see above, when the GC is obtained might be an important factor, not only because of the possibility to work immediately, but also, no need for advance parole, etc. The other side of the coin is that marriage in Peru might be a bit more tricky, however, assuming a visitor visa is possible, marriage can be in the US (after which, you would return to Peru to wait for the process to complete). Marriage in the US has the advantage of being simple and usually fast (depends on the state though); there would be an added expense of the traveling here.

One more thing you guys need to consider: your child has a father and he is going to have to agree that the child leaves the country. You might want to sort that out (unless it's already settled) before starting any process, you don't want to have surprises at the last minute.

K-1 at the end is more expensive, and the time? it depends, it can be almost the same. I think CR1 is a better way. I´m finishing my process with CR1 and CR2 so, i can help u, I have a young child too... and ya, you need to be sure you child´s father will authorize your child will leave the country. I know (from other experience´s mom), getting problems with this.
