My minor son is here in US. He, together with his other siblings who are still in the Philippines were petitioned by my USC husband the same time with me. My AOS and petition was approved last month while the kids are still pending. My questions are 1. How do I file for the AOS for my son? He came here legally through his visit visa and is still in status. 2. Will he fall on the derivative status classification? His I-130 was received last April 2012 and is still pending. 3. Do we need to pay for any fees on filing his AOS?

What type of visa did you enter on and when ? How old is your son.

This will not be over quickly. You will not enjoy this.
