My friend owns her own business and would like to hire me ... she is American and works in America ...I am from Canadaso I know work visa rules are a little different ...how would we get started on this?

That depends what kind of a job it is, how difficult it is for her to find American employees and what qualifications you have.

Work restrictions on foreigners are in place to ensure that no American is displaced by a foreign worker. US work visas are meant to help US businesses that absolutely cannot find qualified American employees willing and able to do the position that they wish to fill. If the job is seasonal (less than 1 year), you're qualified, and she cannot find an American to do it your best bet is H-2b. If she wants to give you a more permanent position (1 year plus), your best bet is H-1b. You'll need at least a bachelors degree related to the position, and she must be struggling to find willing and able Americans for that position.

She'll be the one applying for either visa for you. I'd have her consult with an immigration lawyer.

1. Your friend hires an immigration lawyer. The cost will be around $5000.

2. Your friend proves to the US Department of Labor that she cannot find a US person who is qualified or available for the job and that is why she needs to hire a foreign national. She will need to prove that she advertised for the position. The position must require an advanced degree or expertise. It cannot be unskilled. Once she proves her case, then the Dept. of Labor will issue a certification.

3. Your friend applies for an H1-B visa on your behalf. Since there is an annual cap on H1-B visa, it could take a year to get the visa.

H1 does not require evidence of no capable usc.

The op is Canadian and may qualify for a TN visa through NAFTA.

The op also lists a pending K-1 visa on her profile, it would be good to know if this is in fact true and where the status of this visa stands before giving her work visa advice.
