Background:

 Husband (Me):

- US citizen by born.

- Left US when he was 6 years old.

- First time to come back was on May 2012 (after 21 years).

 Wife:

- Non-US citizen and born aboard.

- Never visited US before July 2012

- Both got married on October 2008.

Current Status:

 Husband:

- Was working for a company in Dubai between Dec 2009- May 2012.

- Working on secondment basis for US company (expected duration 2-3 years) – planning to return back to Dubai after finishing.

- Never filed his income – In process of filing 2009-2011 worldwide income with IRS.

 Wife:

- Currently on B1/B2 visa (Jul 03, 2012 – Jan 02, 2013).

- She wasn’t intending to apply for AOS or green card when she applied for B1/B2 visa.

- Decided to adjust her status due to due to the short period given in her visit visa and her current medical situation (pregnant).

Done so far:

 Form I-130 (Petition of Alien Relative) – Filled:

- Form G-325A (Biographic Information) – Filled for both.

- Prepared an officially translated marriage contract issued in country of origin.

 Form I-485 (Application to Adjust Status) – Filled:

- Form I-693 (Medical Examination and Vaccination Record) – Completed in a sealed envelope.

- Form I-864 (Affidavit of Support under Section A213A) – Pending: income filing transcripts.

- Form G-325 (Biographic Information) – Filled.

Next steps:

 Filing 2009-2011 worldwide income for form I-864.

 Then, send all paper work to USCIS.

Questions:

 What are we doing is correct? Any suggestions?

 Do we need to fill I-131 (Application for Travel Document)?

 By applying for AOS her residency in US will become legal?

 How can we proof that she wasn't intending to apply for AOS or green card when she applied for visa.

this is what we sent and in that particular order ( the famous package) i hope it can help:

FORM G-1145:

- E notification of Application / petition acceptance ( only one for the whole pack and on the very top).

FORM I-130:

- US payable check ($1070)

- 1 passport photo for each of you ( name it on the back )

- proof of your US citizenship ( birth certificate, passport etc only one)

- FORM G-325A (one for each OF YOU)

- divorce papers ( if applicable)

- marriage certificate

- proof of ongoing marital union ( Photos, e-mails, bank accounts, insurance, house lease, etc...)

FORM I-485:

- US payable check ($ 1070)

- 2 passport photos of your wife ( name them in the back as well)

- form G-325A ( only for your wife)

- copy of her passport bio page

- copy of her US VISA

- copy of her I-94 (front and back)

- her birth certificate ( translated into english for a translator)

- FORM I-693

FORM I-864

- all related tax information they requiere on the form.

FORM I-765 ( APPLICATION FOR EMPLOYMENT AUTHORIZATION)

THIS IS FORM WILL ALLOWS HER TO WORK IN THE USA LEGALLY WHILE WAITING FOR HER GREEN CARD IT NORMALLY COST $360 BUT SINCE YOU ARE FILLING THE I-485 NOW THE FEE IS WAIVED, SO I WOULD TAKE THAT CHANCE...

- 2 Passport photos name them at the back

- copy of passport bio page

- copy of I-94 ( front and back)

Form I-131 (APPLICATION FOR TRAVEL DOCUMENT)

THIS IS FORM WILL ALLOWS HER TO TRAVEL OUTSIDE THE US LEGALLY WHILE WAITING FOR HER GREEN CARD IT NORMALLY COST $380 BUT SINCE YOU ARE FILLING THE I-485 NOW THE FEE IS WAIVED, I FOUND OUT THAT YOU NEED A REASON TO TRAVEL OUTSIDE THE US IN ORDER TO APPLY FOR THIS BUT I AM NOT SURE (I HAVE ONE THAT'S WHY WE APPLIED FOR IT)YOU CAN CHECK WITH THE GUYS HERE TO SEE WHAT THEY ADVICE YOU...

- FORM I-131

- 2 passport photos of your wife (name them on the back)

- evidence of purpose of your travel

-copy of your wife's passport bio page

- copy of the i-94

I hope this helps you, once again this is what we did some people might have done different things than we did in certain steps we followed the instructions from the USCIS as much as possible and to our understanding.
